Hello everyone..

So the thing is, my husband got a letter from USCIS on sept 20 requesting for evidence. Just passport style photos from us. We "forgot" to submit, that's alright. But now, reading and reading again it says something, we did not submit sufficient evidence of spousal relationship.. This is driving me crazy :( my husband just submit all the papers that they said to. Nothing else.. It was a terrible hazing.

So, we got the photos... What do you guys suggest to send, besides the photos? Please help me.. Evidence can be anything! But do they need "anything"? I don't think so...

It says "USCIS has reviewed your petition and supporting evidence. The record shows you did not submit two passport sized photos for both. You did not submit sufficient evidence to establish a spousal relationship. Therefore, additional evidence is needed." Then it says to submit two identical passport style photo of both. And the requirements... There is my confusion, it only said to submit photos. So should we submit other evidence in the same RFE? And what kind of evidence, besides marriage certificate? Thank you so much.

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full nameand address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

Did USCIS asked for these requirements as separate questions or on the same paragraph?

Well as separate.. So we're gonna submit any evidence :yes: since we won't get penalized for doing it.
