Hi All,

Here's the story I divorced my ex-wife last year on June 2011 and I got married again with a new wife on 6/2012. I filed last year income tax as married with my ex-wife.

I was wondering if I sent the AOS to the NVC with my tax transcript with my ex wife as joint would affect my application process.

Any recommendations to weither I should sponser her myself or find someone to sponser me and avoid slowing my application.

The petitioner must be the main sponsor. You have to send your I-864 no matter what the circumstances are. You will have to include Your W-2 to income separate from that of your exwife.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

That's not a good news to hear. Are you sure? How come people are sponsoring each others without the petitioner sending his w-2. How about if you never file ?

I am sure there's a way. Thanks

How come people are sponsoring each others without the petitioner sending his w-2 If a petitioner is not providing W2's or tax transcripts its because they didn't work have any income. But no matter the petitioner the Sponsor always has to fill out a I-864.

How about if you never file ? If you have never filed you have to write a letter or provide reason why you didn't file, i.e. you were a student, unemployed. If you were required to file you must settle up all past tax issues.

Maybe talking to a immigration lawyer who is experience in Affidavits of Support. A free consult can't hurt.

How about if you never file ? If you have never filed you have to write a letter or provide reason why you didn't file, i.e. you were a student, unemployed. If you were required to file you must settle up all past tax issues.

08-16-2012 got text message and email.Keep waiting.No NOA1 hardcopy.So we called.
09-17-2012 about this time,got NOA1 hard copy.Priority day August 13th
04-01-2013 cool,NOA2 approved.We both very excited.

05-28-2013 After waiting for almost 2months,Just noticed The NOA2 is wrong.Called USCIS to correct it.

06-11-2013 NVC recieved

06-24-2013 GUZ casefile number assiged

06-25-2013 Pay AOS fee,DS-3032 OPTIN email sent

07-11-2013 OPTIN accepted,Got GZO number

07-15-2013 Got IV fee email

07-16-2013 Paid IV fee

07-19-2013 AOS set sent

07-22-2013 DS-230 IV set sent

08-10-2013 Checklist cover letter

08-13-2013 Sent back the correction AOS

09-25-2013 Checlist cover letter again.But said no need to send back to NVC.just correct it and take to Interview

What would jeopardize your progress is to do something dishonest. You've already disclosed the information about when you divorced. Follow the I-864 instructions and document your own past income from the past tax returns. You'll also document your personal current income. The facts are what they are. Deal with them honestly and let the chips fall where they may.

Facts are cheap...knowing how to use them is precious...

Thanks for your input. I am not planing or even thinking of doing anything dishonest. I was just requesting information and trying to be proactive. But like you said let the chips fall where they may.

I am the petitioner filing IR-1 / CR-1 Spouse Visa I-130. AOS "Affidavit of Support" not Adjustment of status. I think I am in the right thread

Thank you. And my apologies. I only knew AOS stood for Adjustment of Status.

The meaning changes with the context. In the context of NVC, AOS is Affidavit of Support.
