If your friend qualified for public assistance, I imagine that they would not be able to meet the income requirments for a K1 or CR1.

they actually do meet the income requirements, it is because she has a child and struggling

no it will not as long as the person being petitioned for does not go on public assistance once they arrive.

the OP didn't ask about income requirements. If that is an issue the person petitioning can get a co sponsor

if i recieve food stamps can I sill apply for a spouse?.. will it have an impact my case?.. i dont recieve cash assitance, just food stamps..

My lawyer said that this will effect how the USCIS looks at your case... it may not state that this will not impact your case, but it will... if that person is struggeling now and cant afford food (even if they meet the imcome requ.) how will this person pay for food when there fiance gets here? that is how the USCIS will look at that....

let me tell you i had a friend who rented a house from me and i wanted to take them to court for back rent and ecc... but my lawyer said that would impact my case, and in the eyes of the USCIS, i would have an "open court case" even though it was not againt me, it was still a open case....

i wouldnt take the risk of getting food stamps.... if the relationship is real, then you will find a way not to get food stamps while you go through this process... and trust me i know thats a hard thing to do, but you have to do what you have to do to get your loved one here...

Gross income eligibility for SNAP is under 130% of poverty for household size. Household size will increase by 1 for affidavit of support and is over 125% of poverty level. You will most likely require a co-sponsor.

As was brought up in another post, are you talking about WIC, or SNAP? WIC is a program for children under 5 and families of low or moderate income. The income threshold is 185% of poverty.

Your lawyer is wrong. For a spousal visa case, USCIS does not look at financials of the petitioner. Financials aren't even submitted until the file reaches the NVC (a State Department agency). Also, a CO makes the final determination on whether or not an immigrant visa applicant is "likely to become a public charge" not USCIS.

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
