It is clear that you already have intent to marry while your fiance is here on a non immigrant visa. If you marry while your fiance is here in the US on a Q visa, visitor visa or any other visa other than a k1 and adjusting status, is visa fraud and carries a lifetime ban. Don;t try to get around the system it will have dire consequences. The fact of the matter is none of us want or like the fact that we are separated from our SO during this process, but it's the system and it's the law

That is not correct.. Anyone can get married.. Please dont post confusing information.. Anyone can get married anyplace they want.. the only issue is if they try to adjust status.. and the question comes down to "INTENT"...

IT is not fraud to enter on any kind of visa either with or without intent and get married.. it is only wrong to enter with intent to AOS...

There doesn't seem to be an issue here. The GF/finacee got a job at Disney. Disney sponsored her visa. The OP reestablishes domicile, gets a job, etc. The GF works out her contract with the Mouse. They marry, and adjust status.

OP never stated that they hatched a plan to get the Disney job in order to enter the US.

I agree, I see things the same way.

Unless I misunderstood, neither of the people are in the US yet. So, even though I don't think she obtained the visa so she could immigrate, that's her intention now (as I understand it.) I'm no expert, but everyone here always says that it's illegal to enter on a non-immigrant visa with the intent to file AOS.

I should clarify here. She.... actually we have no idea what we're going to do. We don't know when, how or where we're going to get married. I will also be applying for a teaching job in Japan this year, so that we also have the option of going to Japan when she's finished with her stint in the US. But if circumstances are more favorable for us in the US, then we may want to stay in the US. I want to know what our options will be when the time comes to decide.

By the way, why does it matter if I'm in the US right now or not? Did I mention I am an American citizen???

Just relax. Continue developing your relationship, work your jobs, let her work for Disney, when you both feel you are ready to marry do so, and then come back and ask about immigration advice :-)

I think I'll take this advice :)

If you weren't a US citizen we wouldn't be having this conversation. innocent.gif

You've got a path to follow. Come back, get settled, spend lots of time with the GF and the Mouse (Orlando or Cali?), get married, life is good.
