Hello, it is good to be back to the forum after a couple of years with family in Green Card land.

We had the N-400 filed for the Houston office with a priority date of 14 August (the check cashed 16 out of Dallas), due to a very long and complicated story our filing was delayed 5 weeks.... Anyway, my wife and I need to head back overseas for 9-10 months in late December or early January. Currently the website says 5 months of wait.

Is that from Aug 14 to swearing in? I have not read all the posts on the topic yet but my searches so far are not clear to me but again this is a new process for us.

I have a very good connection with my congressman and was wondering if it is worth having them see if they can speed the process up or does that even help? If so when to have them ask?

Travelling back and forth in January or February is not a realistic option so I am trying to get rought idea what the timeline might look like.

Thank you for any opinions and for keeping up such a great website.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Sorry to barge in but my wife will be filing her N-400 in a bit and I am doing the background work to make sure it goes smoothly. The USCIS documents all say that one cannot apply until the following: [as] a spouse of a US Citizen, you can apply for citizenship 3 (three) years after approval of your Adjustment of Status. (Emphasis and underlining is mine.) But some of you are applying 90 days before that? How? Where is that permitted?

Specifically adiiann listed the GC expiration date of the AoS to get the RoC as 10/26/2011. Based on that, from what I read, the N-400 filing should not have gone in until 10/26/2012.

Please enlighten me!

Hi. By October 26, 2012, I will be 3 years resident here, which in 3 years rule resident and married to USC, I can file for my citizenship. I can file 90 days earlier before my 3rd year of residency, however prior to my filing, I need to be 3 years or more married to my husband. That's why I filed after August 8 which is our third year anniversary but still days earlier from my 3rd year residency.

Hi. By October 26, 2012, I will be 3 years resident here, which in 3 years rule resident and married to USC, I can file for my citizenship. I can file 90 days earlier before my 3rd year of residency, however prior to my filing, I need to be 3 years or more married to my husband. That's why I filed after August 8 which is our third year anniversary but still days earlier from my 3rd year residency.

The document says 3 (three) years after approval of your Adjustment of Status not 3 years after the marriage. Can you point me to a document that advises differently? For that is is worth I married my wife in September 2009 but we got the GC in February 2010. Some folks claim my wife can file in November, but the only thing I see inclines me to believe she must wait until February.

-Have been a permanent resident (green card holder) for at least 3 years

-Have been living in marital union with the same U.S. citizen spouse during such time

So you have to meet both requirements, and you can file 90 days before the latest date.

For example: I got married July 2009, and got my GC October 2009. So I become eligible to file October 2012. Minus the 90 days that would make it early July, but I waited until August to file because of the 3 year marriage requirement, and I didn't want to cut it too close.

Hi Stormbringer, one more question!

Does my wife have to refile documents that she already filed as part of the K-Visa/AoS/RoC process or can she reference that they are already part of the record? In this regard, I am thinking about divorce decrees, annotated marriage documents from the Philippines, Land Titles, two of the three years of tax returns... et al. Most of what the N-400 asks for we already filed with the USCIS in the proceding steps. Are you refiling everything?
