Re entry permit with remove conditional 2-year green card

Hi everyone @ Visa Journey,

My wife came to the U.S. 2 years ago, got married and holding a conditional 2-year green card. Currently the green card is about to be expired. She is apply for the permanent 10-year green card. I was told that she should apply for the re entry permit at the same time while she is applying for the green card and she only has to pay for the fee of getting the green card and not having to pay for the re entry permit??? Is there such a thing in general? My question is if this is true, will this delay the process of getting the 10-year green card or not?

are you saying that she left the country after she received her 2-year green card until now? How long have she been out of the country? Do you know green card is different from passport and she can't stay in other country for long period of time, otherwise she will lose it if without application.

She needs to apply for removal of conditions, and can do so starting at 90 days before the expiration date. When she applies for ROC, the receipt notice will also act as a one year extension for her green card. She can use that receipt along with her expired green card while waiting for the 10 year card to be approved. No need for a re-entry permit. http://www.visajourney.com/content/751guide

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I think it's worth mentioning that I consider re-entry permits as good insurance for LPR's planning on being out of US for more than 6-months and an absolute requirement for more than 365 days (& <2 years).

Otherwise I think they are not needed as it should be relatively easy to prove the LPR's trip is temporary in nature and is 'maintaining residency'. (please note - a continued history of short visits to the US every 6 months could be viewed by USCIS as having abandoned residency though.)

I haven't heard of applying to remove conditions and a re-entry permit at the same time with reduced/waived fees, but that doesn't mean it's not a possibility. Possibly an infopass appointment could clarify things for you, don't hold your breath though...

Why were you told to have wife apply for REP?

She can travel with her expired Green Card AND the ORIGINAL I-797 letter which extends her LPR status for a year. You'll get that after you sent the papers for ROC.
