i applied for my husband last year in 2011 after our first anniversary.

he had his interview in Nov 2011 since tht his case under AP.

today he collected his passport he got his visa. on visa stamp its says he married also he got CR1 visa. its gone expire in Dec on our anniversary date.

so i want to know what we need to do when he gone arrive in USA do he need to tell tht officer his married over 2 year. i am gone arrive with him there gone be any problem. i m gone on wheelchair so he can go with me or do he have to go by himself.

06-15-2011- NOA2 Status Update(Priority Date)

NVC - 08-01-2011- NVC Received (After 48 Days)
08-19-2011- NVC Case# & IIN Received by email from NVC & E-mails Exchanged (After66 Days)
10-04-2011- Case Completed 10-07-2011- Called NVC and Received Interview Letter by email
NOV-2011- Interview (AP)
06-05-2012- Visited at Embassy Second Time
06-08-2012- Received Message from VFS Collected on 11th asking for New Medical
06-12-2012- Medical Done Send Back on 14th
06-25-2012- Received Message From VFS Collected on 26th asking for New Passport Clearance gone be Expire on 28th.
07-10-2012- Send Back New Passport & Passport Clearance
07-16-2012- Received Message Collected on 17th July He Got His Visa.(less then 8 months)

07-31-2012- POE

08-08-2012- Green Card Received for 2 years

05-12-2014- Apply for I751 at California

05-23-2014- Received letter said tht apply for I90 (incorrect card because of uscis error)

06-10-2014- Send I90

First of all congratulations. I assume you are speaking of when he first arrives in the US? That is called a Point Of Entry or more commonly POE.

When he arrives, the CBP officer will ask him some questions. He just needs to answer them truthfully. He doesn't have to "volunteer" any information. Whatever they ask, he answers.

So when you say you are going to arrive with him, do you mean you are going to India then flying back here together? Or do you mean you are going to go to airport to pick him up?

If you are flying together, when you arrive in the states, just stay together through customs together.

If you are picking him up at the airport, you can not meet him at customs, so he will be by himself for that.

You submit the actual green card and keep a copy. The stamp on the visa in his passport serves as a temporary green card for a year.

If he arrives in the timeframe that Push mentions,

then be certain that he asks that his visa type be updated to IR-1 at the POE. A Supervisor at POE may be needed, so remember that. Also remember that coming through a POE after a long, gruelling flight - most people forget to ask about this, to get it 'corrected'. Show the marriage certificate at the POE, ask for the upgrade... It's worth the extra time at the POE to get this done.

Yes, do mention it and ask that the IR1 "status" be noted. The "visa" will not change. Only a Consulate can change a visa category but this is not necessary. CR1 and IR1 are both an immigration status and a visa category.

thanks NLR for respond but it not easy as it sound I view some topic ( most of them ) although they mention it at e.o.p and change the state to IR1 they still get 2 year green card from uscis then contact uscis for 3-4 to get the 10 year g.c by the end . and other get it direct

what I try know sure steps to not give them chance to give me hard time . i already had enough

That is all you can do. There is no shortcut. Bring the marriage certificate to the POE, make sure the stamp and paperwork at the CBP POE says IR1 and then if the green card is wrong you send it back ASAP free of charge to be fixed. The endorsed visa from the POE acts as a green card for a year.
