F1 Student Dropped from Classes

My fiance and I are getting married in less than two weeks. He was supposed to go to school for summer quarter in order to maintain F1 status, but we decided to use the tuition money to get married. Thus, he was dropped from classes on July 3 due to non-payment. We plan to file the AOS paperwork within days of our marriage.

Is he still in status until his school makes a move to terminate? How long after non-payment/non-attendance does a school typically take to terminate the SEVIS record? We don't know what to expect at this juncture.

Obviously he isn't in status, the question is...has the school reported it? To answer that you'll have to ask the school.

At the moment he is in the country illegally. His visa expired the moment he dropped off school, if his I-94 contains the marking 'D/S'.

Note: the verbiage 'we decided to use the tuition money to get married' may be subject to misinterpretation by 3rd parties.

Thank you for letting me know that my wording may be misleading. In all seriousness, how might I better express our decision to use money for a wedding that would have been spent on courses? It was a financial decision, not an immigration one. :)

Just my two cents on the bolded, if he his no longer in status then consider a cheap-ish wedding and put the tuition money towards the $1,500 + medical to file his paperwork so that you both can rest easy at night knowing that there won't be a knock at the door coming.

You can always have the "big" wedding later :)

IMHO, you would be better off by not mixing the financial aspect with the decision to marry, although I find it hard to dissociate them in the real world. My presumption is that your marriage is legit and that the actual reason you got married is because you love each other. However, the costs associated with starting a family and continuing one's studies may be prohibitive.

When you say 'it was a financial decision, not an immigration one' an immigration officer may hear 'we got married because of money, unconcerned with immigration might think' and that may be misconstrued. Please correct me if I am wrong, but my understanding is that what you mean is that your fiance dropped off from school because as a result of your marriage the two of you could not afford a family and school, so he opted for your family.

On a completely personal note - admittedly uncalled for in the realm of this forum - I wanted to suggest that once you settle down and get your married life going, talk to your soon-to-be husband and consider a budget where he may get back to school. Good jobs are far and few in between these days and things are only getting tougher. An education - any education - might give him the necessary additional skills to secure a better job and provide for your family.

honestly guys, i have to agree with what gegel says.

you can get a marriage license and get married in the townhouse for about $100 in most counties. maybe this is not the right place to be voicing this opinion, but really.. go back to school and get an education. with a good education you can get way ahead and life and will be able to afford a pompous and well deserved vow renewal.

The tuition money is being used for immigration's forms. We are having a tiny, tiny wedding performed outside with a few guests. We don't care much for pomp and circumstance. For what it's worth, my fiance has a bachelor's degree from his home country. He was here for graduate school. He will likely continue once all of this is said and done. It is simply much less cost-prohibitive for him to return to school as a permanent resident, which is better financially for our new family.

If I were you, I'd get down to the courthouse and get married, then get filed. Don't wait 2 weeks. Maybe I'm overreacting, but I'd be scared as hell in your situation.

Our wedding is on Thursday! Yes, it's been a little stressful to wait, but we have family and friends that want to attend. Just a few days now...

6/19/2012 - Biometrics completed.

7/02/2012 - Text/email/hard copy notification of interview.

7/30/2012 - EAD card production ordered.

8/02/2012 - Interview @ 2:00

8/02/2012 - Email notification of GC production at 5:30pm

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

The tuition money is being used for immigration's forms. We are having a tiny, tiny wedding performed outside with a few guests. We don't care much for pomp and circumstance. For what it's worth, my fiance has a bachelor's degree from his home country. He was here for graduate school. He will likely continue once all of this is said and done. It is simply much less cost-prohibitive for him to return to school as a permanent resident, which is better financially for our new family.

I wish you guys the very best of luck and a happy married life. File concurrent petition and aos immediately and don't leave the country till it is approved.

2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship

Good luck guys, please file ASAP, I was taken into custody of Ice after going out of status on the f1 visa and it wasn't pretty. Best best of luck!

About being out of status, I know that my husband get's one term "off" per calendar year as a break (basically a summer break) in which he is allowed to stay in the country legally. He may still be in status, check with the school.

Day 0 - 2 May 2012 Mailed AOS package overnight delivery
Day 139 - 17 September 2012 Interview & APPROVED on the Spot!! :)
Day 145 - 23 September 2012 Received Green Card!

ROC - Eligible June 19 2014

Day 0 - 18 June 2014 Mailed ROC package via 2 day priority

Day 42 - 29 July 2014 Approval and Card Production Email

Day 49 - 5 August 2014 Received Green Card
