Hi all.

so, I am wondering what the difference is between the K1 and K3 visa? And I also understand there is an interview process. What is this interview process? Why is it required and what happens in this?

In regards to filing the documents - what sorts of questions do they ask on the document/form?

K3 is obsolete. Forget about it.

Read the guides for the K1 at the top of this website and at USCIS.gov. Sounds like you very new to all this and you need to do a lot of reading!

HUSBAND'S CASE

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

absolutely my friend - new at this and need some information! :)

ive read some things about the K1 visa. Basically, eventually, I am hoping to migrate to US. The business route I had is not possible so the only option left is to see if my girlfriend would want to marry. If so.... then great and I would need all the info/help I need!

but in general, what is the interview process all about? What happens?

As I am a little confused, you say K1 is a fiance visa. Does this mean that you must get married within 90 days and then apply for citizenship?

the CR1 you refer to - what is this and the process?

You should start by reading the comparison chart to learn more about the pros/cons of choosing the K-1 or IR-1/CR-1: http://www.visajourney.com/content/compare

Long story, short: If you go the K-1 route, your fiancée would need to first file a petition (I-129F) on your behalf. Once it's approved and sent to the US Embassy in London, you (the beneficiary) would need to file additional paperwork, attend a medical exam, and have an interview at the Embassy. (For more details on the interview, visit the Embassy Reviews section for the UK.) Once the K-1 is issued you will have about 6 months to enter the US. Once you enter, the K-1 visa is voided as it's a one-time entry visa. From there, you are required to get married in the US within 90 days. You will not be able to leave and re-enter the US until you receive either Advanced Parole or a green card, which can take several months.

So, if your goal is to save money before moving to the US, you may want to opt for the spousal visa where you'll get married and then your wife would file the I-130 petition.

But again, start with the comparison chart to see which option is best for your situation.

k1, you file for i-129f once approved and the beneficiary is in US already file for AOS(adjustment of status) and wait for GC

k3, get married file for i-130 and i-129f, once it is approved and the beneficiary is in US already file for AOS and wait for GC

cr1, get married file for i-130, once it is approved and the beneficiary is already in US all she/he needs to do is wait for her/his GC.

The K-3 is obsolete, so I wouldn't include that as an option. It's either K-1 or the CR-1/IR-1.

I know, i am only answering his question if what's the difference between k1 and k3, i even said on my previous comment that it is better to do the cr1 route rather than k3.

You'll be applying for a greencard which allows you live and work in the US. They mean that...live and work in the US, not just pop in for a visit and spending most of your time in the UK. Citizenship will be available to you three more years after the greencard is issued if you remain married ,to the same US citizen. So count on around four years total to be a citizen after you are admitted on a fiancé visa, allowing processing time to get the GC and more waiting to become a citizen after you are eligible to apply.

Edit: Forgot to add, interviews along the way will be to determine if your marriage based visa is legitimate or if it's a scam to get in the US because you couldn't come up with a good way to move here and start your business in the US. You already stated in another thread that was your main reason to want a visa to the US.

and? am I not allowed to have a life? am I not entitled to ask questions? jeez.... it was a simple thing. I dont really have to explain myself to anyone or about my life :)

the fact is, I want to expand my business but also to live with my girlfriend and have a future and the best place would be the US for logistical and conveniant reasons.
