Ok someone please help me. I have written the USCIS many many letters some certifed and all notarized telling them to please cancel my husbands I130 Petetion and I will no longer be persueing this visa thing and divorce is in process. Many calls due to no update online showing the case cancelled or no letter back saying it was cancelled. No help on the phone, the people read from a screen and are clueless. What do I do? I dont need this shaddy guy going to the embassy and trying something slick. But here is the KICKER, online it shows petetion will expire 6/31/12,( days ok) yes its been a long process. But it still shows almost active, dont say expired just says that at the bottom, did it expire? Any help please here, Id appreciate it.

Well officially the embassy should not renew the petition without the US citizen's secondary approval. However, I would continue to contact USCIS regarding cancelling it from your end. Ask to talk to a supervisor.

Calll NVC and see if you can get one of their operators to check on the case. If you hit the right person they can see what the file status is. Email the consulate also if you were at the stage where you have the country specific case number.

This will not be over quickly. You will not enjoy this.

Okay is this a situation where you have gone through process denied and it went back to USCIS. Or is this the initial petition and you are still waiting for the approval (NOA2 notice). I mean did you already go through the whole process to interview and get a denial?

Yes the case was denied last year and sent back to the USCIS. On the site it says its awaiting review after being returned, with at the bottom showing it expired. I have waisted countless hours on the phone with people who claim they are supervisors at the USCIS blah blah. I just want something in writing I guess showing it is cancelled. I mean do I need to pay a lawyer to cancel it Ive made over twenty calls over ten letters. Im lost.

Ok the problem may be that it is your husbands case so you can't cancell it technically. What you need to do is write them and tell them you are withdrawing the I864 attached to the case. If there was a co sponsor they can do the same. That will kill the case.

This will not be over quickly. You will not enjoy this.

Have you also contacted NVC. I don't know for sure do they send a letter of cancel request. They are probably ignoring or don't know because it expired. If you were denied and it came back you probably got the NOIR where you have that 30 days to respond. That may be that date of expiration. Its a denial so not really much that can be done.

omg the last time i read your status u were really excited about bringing your hubby to te usof A wow when did all this happen.Am really sorry for your wasted effort time and money .Above all the pain u are going through now that u realised u were living a lie With this two face.Its very sad when u think someone loves u and they really dont.wow.Am really sorry.HOPE U FIND A SOLUTION TO STOP HIM FROM COMING TO THE UNITED STATES BEFORE ITS ACTUALLY TOO LATE.:(:thumbs:

The thing there care about most is that someone is sponsoring him If you never sent an affidavit of support he would never have had a chance of getting a visa and never will.

This will not be over quickly. You will not enjoy this.

assumptions:

1. there was at least one interview at an IV Unit, the case was sent back to USCIS

2. casefile somewhere between USCIS and the IV Unit currently.

who to contact:

1. National Visa Center Hotline - get a Supervisor. Tell them that you want to withdraw the petition, and want to know which office the casefile is at.

2. get stumped? Use GoGo's directory: GoGo - http://www.visajourney.com/forums/topic/221091-uscis-contacts/page__p__3365596entry3365596

Supposedly:

1. you can get an infopass appointment and withdraw the I-864 at a local USCIS office. Do that, they'll forward it on electronically (this notice of withdrawal) everywhere it needs to go (DHS, USCIS, DoS, CBP).

2. if you send a letter of withdrawal of I-864 to the Fraud Unit at the US Embassy, they will handle all with the Embassy.
