Hi everybody,

We are filling out our I-130 petition but we have few questions:

1.Im a Moroccan citizen but we have lived in Cyprus since October 2011.We hate being separated so after my husbands contract ended without a notice in Istanbul,we rented a place here,we don't have a residency permit here but we do have permission to stay 90 days at the time that we break every 3 months by crossing visiting turkey or the other side of the island for few hours so we can get an other 90 days.WE are not illegal but we live here on a renewable Visa,we just don't have the right to work here because of the work permit thing. But we have a rent contract with both our names on and our daughter who is an American citizen as well was born here.So would it be correct to state Cyprus as our address?

2.In the petition,we put our address here in Cyprus,so for the interview do you guys think it will happen here?seeing as how we cant even stay as a couple in a hotel in Morocco because they wont recognize our marriage license as an Islamic one -my embassy wouldn't even give my daughter the Moroccan citizenship because of her non Arabic or Muslim name and because we didn't marry by the Islamic way.I ve become a christian few years ago before i met my husband and by respect to our faith and theirs,we wouldn't sign a paper confessing we are Muslim just to get a Moroccan marriage certificate so we preferred to have our wedding and our life here.

3.Can we just fill the petition and take it to the Nicosia-Cyprus American embassy in stead of shipping it to Chicago?

We just don't want to make any mistakes.

Thank you,

3.Can we just fill the petition and take it to the Nicosia-Cyprus American embassy in stead of shipping it to Chicago?

No, the Embassy will not accept it.

The main issue you might have is that the Embassy will require a Cypress police certificate from you, since you have not been residing in Cypress on a residence permit, you could possibly encounter difficulty obtaining this certificate.

Read that, a bit.

IMO (also) yer gonna have some issues with the police certificates at NVC intake time.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Thank you all for your quick answers :) .

They state in the petition that even if you worked illegally you need to list it,that's why im a bit confused here thinking that the same rule apply for living abroad.I will ask my immigration consultant and let you know.

How long do you think the process for an USC spouse and mom to get everything approved?our plan at first was to live in a neutral area to avoid any problems that may result of the confrontation of one of us to the other ones culture, but my husband cannot find work outside the us and is getting terribly home sick day after day.

Has he applied for a posting at the UN Agricultural Commission in Roma ? That's an exceptionally nice slotting, as most of the jobs are 120K euro/year with housing, utilites and car provided. You'd be surprised what a clerk there can do on wages.

Thanks for you response, but to work with the UN anywhere in Europe, they ask for a EU Work Permit which is almost impossible for him to get.

Since almost a year,he has been sending several CVs a day,but nothing,so once the petition is approved hell go back the the states to work -he has work waiting for him there-,for the Affidavit of Support.

Hi there

My husband and I are living in Cyprus also, but in the south (EU). He is a British citizen and I am a USC. We are filing from Cyprus. The embassy in Cyprus, which is in Nicosia, will not accept DCF applications as of last August. So you will have to file with the Chicago lockbox. I sent our packet to my mother in the US and she forwarded it on with a US check. I assume our interview will be in Nicosia when the time comes. My husband is a legal resident here but I am not (however, I am not working). We are hoping this will not be a problem but I don't know how it will be if neither of you are legal residents and filing from another country. I believe that the interview is conducted in which ever country you are filing from. It would be nice to keep in contact with you and there are not many other VJers who are filing from Cyprus!!!

Good luck! x
