Hi,

My husband (USC) and I (I'm from Spain) got married last January in Las Vegas. Due to his work we are currently living in Slovakia, and we are not planning to stablish in the US in the near future but I would like to start the process to obtain my green card just in case we move there sooner than we think, probably in two years or less. The thing is that his house in Texas is rented at the present time and he doesn't have any residence other than his parent's house when he goes to the States, so when it comes to question number 18 "Address in the United States where your relative intends to live" I really don't know what to answer. Could I leave this quiestion blank?, should I put my fathers's in law house or the house that he owns but is now rented?, and by the way, what address should he write in "Information about the petitioner"?, the one who is rented but is under his name or his parent's house where he stays when he goes to America and where he recieves his mail?

You cannot get a Greencard if you do not plan to live in the US. A Greencard holder must maintain presence in the US or get their GC revoked. Wait until you are ready to move to the US. You cannot keep or get a Greencard "just in case."

You cannot get a Greencard if you do not plan to live in the US. A Greencard holder must maintain presence in the US or get their GC revoked. Wait until you are ready to move to the US. You cannot keep or get a Greencard "just in case."

+1 on this. Lawful permanent residence is granted to people intending to live in the US permanently, and can not be gained or maintained without planning to live there. If already a green card holder, you'd have to apply in advance to maintain status if you planned to live outside the US temporarily for longer periods of time.

That being said, my wife lived with her parents at the time of filing and we wrote that address. Now she doesn't and that's ok, because you're allowed to change your mind after filing the initial petition.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Hi Laura,

Just to be clear you are referring to the I130 form right?

If so, for question 18 you can list - to be confirmed. This is what we did as both petitioner and beneficiary were residing abroad. For the "information about the petitioner, we listed our Australian address. That is where we recieve all mail from NVC. we didn't have any problems and our petition was approved in 8 days due to auto expedite queue for USC residing abroad.

I think planning ahead is a great idea however, you will only have 6months to enter the USA once the visa is issued.

The other point to note is the other replies to your question are correct but they are referring to the AOS package where your husband will have to prove US domicile or reestablishment of domicile.

USCIS Stage - 10 days total from package received to approved

03/09/12 - I-130 package sent

03/12/12 - package received

03/14/12 - NOA1 received via email

03/22/12 - APPROVED - NOA2 received via email - USC living abroad (8 days)

03/27/12 - NOA2 received in mail

NVC Stage - 34 days from case number to case complete - including messy RFE

04/17/12 - Case has arrived at NVC

04/27/12 - Case number received (25 days from approval)- sent DS3032 via email

05/02/12 - AOS bill received via email

05/03/12 - AOS bill paid via portal & DS3032 accepted

05/04/12 - IV bill received and paid. AOS bill appears as PAID.

05/05/12 - IV bill appears as PAID. Still waiting on replacement marriage certificate.

05/11/12 - DS230 and I864 packages (without marriage cert) sent to joint sponsor before being forwarded to NVC

05/16/12 - marriage cert sent direct to NVC

05/17/12 - I864 and DS230 sent to NVC overnight via fedex - received 05/18/12

05/25/12 - checklist for original marriage and divorce certificates - marriage certificate delivered to NVC

05/30/12 - divorce certificate delivered to NVC

05/31/12 - AOS package accepted - thrilled!

06/01/12 - CASE COMPLETE!!!!!! (email received)

06/07/12 - Interview Date Assigned

06/08/12 - emailed Sydney IV to request earlier appointment - approved 07/03/12

07/11/12 - INTERVIEW DATE - APPROVED

10/06/12 - POE LAX (then onto Seattle)

I think people are talking about OP herself. Not about husband's US domicile.

You can put "not decided yet" or just put your father in law's address. CR-1 visa expires in 6 months so keep that in mind.
