Hi Guys,

First of all, i would like to thanks to VJ & all its members for helping, i have one more question, i have a question in i-864 form Question no 3

which is ,

Part 3

8. I am sponsoring the principal immigrant named in Part 2 above.

YES No (Applicable only in cases with two joint sponsors)

9. I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant

named in Part 2 above. Do not include any relative listed on a separate visa petition.

i am using joint sponsor also to sponsor my wife & my 9 months old daughter also, because i am not making enough income to sponsor my family, the joint sponsor is not my family, its my close friend,

so please help me in PART 3 (8.9)answers. thanks in advance

Im just curious about why your daughter needs to be sponsored? If she is your biological daughter and you are a USC, she will have claim to citizenship. And therefore wont need to be sponsored. Or have i missed something here?

09-14-2012 : Emailed Embassy and confirmed DS forms have finally been logged (After 29 days)
09-22-2012 : Interview letter received. Dated September 19th.
10-03-2012 : Interview - Approved!
NOA1 to Interview - 138 days.
10-10-2012 : Passport with Visa delivered two hours late at 8pm.
10-22-2012 : POE Philadelphia
11-15-2012 : Green Card received in mail
12-11-2012 : Went to the Social Security office to apply for SSN after it did not arrive.
12-15-2012 : SSN Arrived in 4 days.

05-09-2013 : Left USC Husband.
11-28-2013: Filed for divorce.

05-01-2014: Divorced

05-08-2014: Sent I-751 petition to VSC

05-13-2014: NOA1 (was not postmarked until 5/22/14 and received on 5/24/14)
06-18-2014: Biometrics in St. Albans, VT

11-21-2014: RFE. Received on 11/24/14.

01-22-2015: Interview notice mailed out. Received 1/26/15

02-12-2015: Interview in St Albans, VT - Approved during interview!

08-16-2012 : CRBA in London for our daughter - Approved!
09-11-2012 : CRBA and Passport arrived.

Part 3 question 8 is YES. You are still the main sponsor eventhough you have a joint sponsor.

Part 3 question 9 you would list the daughter IF she is your stepdaughter and not your biological child, and therefore not a US citizen.

Im just curious about why your daughter needs to be sponsored? If she is your biological daughter and you are a USC, she will have claim to citizenship. And therefore wont need to be sponsored. Or have i missed something here?

Clarification would be helpful, yes but if there is a need for sponsoring two separate immigrants, each of which has their own petition, each immigrant will have two I-864 forms in this case, one from the petitioner and one from the only joint sponsor. In both cases, "none" will be entered in the section referring to other family members. On the affidavit for the spouse, do not count the spouse again in the dependents section but do count the child in the household by adding them as dependent child. For the Child's affidavit(s) DO count the spouse in that section but do not enter the child as a child because the child is already counted as the intending immigrant.

Yes she is my Bilogical daughter, it was my mistake that i apply for I-130 instead for consular report of birth at us embassy in canada, but nothing

i can do now, i found VJ website after filing i-130, anywayz thanks a lot for all of you guys, as i told you guys my friend is a joint sponsor so what will be the answer of the question from joint sponsor I-864 Part 3 question 8 & 9 thanks a lot engineer21, pushbrk & Holly2234

I would cancel the I-130 for your daughter and make an appointment for the CRBA. Montreal won't approve a visa for a child with a claim to citizenship.

Yes, there is something to do now. If your daughter qualifies for US Citizenship, there will be no visa issued. It would be a total waste to pay the IV fee bill for her. The petition really shouldn't even have been approved under those circumstances. Stop processing on the I-130 through NVC and file the CRBA.

Thanks all of you, for replying, i cant cancel I-130, case is almost 70% complete, if i cancel i am afraid its going to be more delay, my daughter is now 10 months, i cant wait to see her, i know i paid $420 for I-130 fee & i have to pay 400 for immigrant visa fee, but atleast i am sure she will be with me in couple of months, anywayz thanks for all of you, i hope u guys understand my situation. please reply for my another question.

my friend is a Co-sponsor what she suppose to write down in Part 3. question 8 & 9

You aren't grasping the importance of what's been said in prior posts.

Your daughter will not be issued a visa because she has a claim to US citizenship. So you need to get her a US passport so that she can travel to the US.

Without the US passport, your daughter will stay behind in Canada.

Thanks all of you, for replying, i cant cancel I-130, case is almost 70% complete, if i cancel i am afraid its going to be more delay, my daughter is now 10 months, i cant wait to see her, i know i paid $420 for I-130 fee & i have to pay 400 for immigrant visa fee, but atleast i am sure she will be with me in couple of months, anywayz thanks for all of you, i hope u guys understand my situation. please reply for my another question.

If your daughter does have claims to US citizenship through you, you can be sure she won't be issued a visa because she isn't eligible for one. By then, you would have wasted time and money that you could have spent on the CRBA process, which is the appropriate path for her.

NVC

04/23/12 - NVC received both cases (18 days/12 business days from NOA-2)

05/07/12 - Case numbers and IIN's (14 days/10 business days since NVC received)

05/08/12 - AOS fee invoiced, paid - "IN PROCESS"

It is actually NOT too late to "withdraw" the daughter's petition but it isn't necessary to do so. You can just notify NVC, that you've done the CRBA instead. Waste your money if you please but it will NOT get your daughter here. She will NOT be issued a visa when she is entitled to a passport. Visas to the USA are for foreigners. Your daughter is not a foreigner. She's a US Citizen born abroad who need the proper paperwork for a passport prior to travel.
