I came to America with a K1 Visa along with my son(7 years old) K2 since 2008. I married my husband (US Citizen)in 2008 and change my last name to his, but my son can not change his last name to be the same as mine, he have to use his Thai last name (His Thai last name is not his biological father's last name my son changed his last name to my unmarried last name since we divorce in 2007).

We both carried a 10 year green card until I become a US Citizen by naturalization in May. Now we both (me and my son) got a US Passport this week.

I would like he have the same last name as I use,

1. How can I change my son Thai last name to mine ?(he did not use his biological father's last name, he use my unmarried last name since we divorced 2007)

Through the naturalization would have been the easiest. It's right there on the form.

Yes, name changes are a court proceeding. Check with your local clerk of court office. If it's not also inconvenient for your husband. headbonk.gif

Despite that your son's name is not your ex's, you may well still need permission from him...even if you have sole custody and were allowed to bring him to the United States.

I would suggest you contact a family lawyer to ask. It's easy enough to change a name if you have the right to do it - it's a simple search on Google - I searched for 'Virginia Name change' and found the approriate form for my state and county.

Adoption is the only way you can get a new birth certificate for a child with the new parents name on it. I suppose you can go to a court of law to get that name change, but the child will still need that original birth certificate for a paper trail plus along with that court ordered name change.

Changing the name to the stepdad won't make that stepdad the legal parent of that child, could fool the neighbors is all, biological father still has the say. Will need that original birth certificate to enroll in school, get a driver's license, or a US passport, also for any SS benefits.
