Will spouse be considered conditional or permanent resident?

Hello,

I filed an I130 for my husband who lives in Haiti 6mths after getting married. Going back and forth between the States and Haiti had caused some delays in completing the case. To make a long story short, our case is complete and we are awaiting an interview (which by the way NVC has no clue when it will be :ot: ). We have now been married for a little over 2 years. Will he be a conditional or permanent resident? Thanks.

The US Consulate probably will issue the IR1 (10 YEARS GREEN CARD). Even if the US Consulate issue the CR1 your husband is entitled to get the IR1 upon arrival at the U.S. port-of-entry. Tell your husband to remind the CBP officer that he got married more than 2 years ago.

Agree with Sandra. Whether he is issued a CR-1 or IR-1 it is his ENTRY date that matters. As he will be entering after more than 2 years of marriage he will get a 10 year card.

Thanks guys and gals. I recall reading somewhere that based on similar circumstances he would automatically ger a 10 year greencard. Oh well either way Im just anxious for him to get here.
