This is my first time here. My friend suggested I travel to Thailand to see my fiance a 2nd time.

We just got our initial receipt for K1 on April 16. My question is can she apply for a tourist visa

to come visit me this summer and could this count for our 2nd visit. Are there any pro's and con's by doing this?

Could this adversely affect our K1 application. This is a great site and we will document our process.

Thanks

Mike

Hi and welcome to VisaJourney!

I got some good news and some bad news. First, the bad news. During your tourist visa interview, you will have to show no immigrant intent. Unfortunately, a pending I-129F is everything but that. The chances are extremely high that once the CO sees the petition in their system, you will get denied. The good news is, you can always try and you have nothing to lose (except for the visa fee), as being denied a tourist visa has absolutely no effect on the K-1 process.

Good luck!

Thanks for the info! Do you think it is important for me to travel back to Thailand for a 2nd time. Will this up our chances for the K1? I will go back if it makes a difference. Thanks again for the quick reply.

Like the previous poster said, a denied B-2 visa for lack of ties has no effect on the K-1. A K-1 applicant is already assumed to have immigrant intent, so a denied B-2 for presumed immigrant won't matter.

As for a second visit. It's definitely a major plus. Remember, they want to see evidence of a real relationship, and more than one trip is good evidence of this.

Welcome to the forum.

Generally, for visitor visas, the visitor must be able to demonstrate to the satisfaction of the Consulate Officer that they have compelling reasons, or ties that would show that they will return home to their country after visiting. The necessary level of proof seems to vary from country to country. Check with your regional forum for more specific information.

If you can travel back for a visit, do it. You have a great opportunity to acquire more evidence of an ongoing relationship, to say nothing about other obvious benefits.

Good luck.

There is zero chance she would ever be granted a tourist visa. She can apply at any time & as many times as she wants. The resulting denials will not affect the K 1. It will affect her mentaly which is something you wont be able to help her with long distance.

Many K 1s are approved based on the one visit requirement. Visiting her more than once certianly helps the case but isnt required. There is no reason to believe she wont be granted the K 1 visa as long as you both follow the procedures. Begin now to document your relationship while educating yourself about the requirements of presenting your case.

I suggest you buy a copy of Thailand Fever from Amazon. Have her find on in Thailand at any book store that supplies books to farang or send it to her. Spend your time investing in your futures. Have her begin to study the USA, its people & English.

Hello there!

I applied for a flusher visa while Im still waiting for my k1 and I was denied of course.Elbe though I've been in the states before and had a previous history and always came back home, itneedle more than just that. The k1 visa is an immigrant visa so it's hard showing them your intention of coming back home.

I have a question though, when I will fill my documents for the interview i DO have to state that I was denied right? Does this count as a denial?BIn not sure if this question will be in any of the DS but just to make sure...

And good luck to you! l

Me and my exwife tried this 10 years ago. Didn't work then, probably won't work now. She admitted to return for K proceedings to do everything legal, didn't matter. The consulate told her "you just don't want to wait for your K visa". They were nice about it, but gave her the nasty black denied stamp. No problem getting the K a month or two later...

Tourist visa isn't gonna happen. Especially since you have a pending K-1 out there. Put your head down on concentrate on the K-1. It'll be over quicker than you think.

ETA, I personally know a girl that got a tourist visa and then adjusted status. She got away with it. It's exactly the reason they make things difficult.
