I watched some videos linked on another post on the visa process and they mentioned proof of being single certs, possibly needed for both parties. I had not seen anything required from the petioners. This made me wonder, I have never been married, I'm 63, does anyone ask me to prove that? :-)

PS, my 1-129F package should be on the way next week! :-)

Weren't those geared towards a specific country?

Your signature on the I-129F petition plus the letter of intent that you include with the initial package. Sure, one could risk the wrath of the government (the penalties are laid out in the I-129F, too) by submitting the petition without being 100% free to marry...

You need to be free to marry. If you were married and divorced, then you need the divorce decree.If you were never married most countries will not require to prove it, since that may be impossible. But there may be some countries that may ask you to sign something attesting to that fact as a matter of formality.

This is country specific and asked for at the US embassy by the. Often talked about is the CENOMAR that people from the Philippines need to get for the interview.

Check this out here is some info. and forms your will need. After you get a state seal from your governors office stating the forms are accurate and your single then you send that into a Chinese Embassy here they will send it all back with a marriage eligibility stamp. Hologram sticker take that to China with you and give it to the marriage agency when you get married.

The petitioner does not need to provide proof of being single if you have never been married before. It is however a requirement that you have met your fiancee with in the past 24 months, and both the petitioner and beneficiary must provide a letter of intent to marry eachother, dated and signed.

:thumbs: Also, the updated letters of intent that the beneficiary will provide at the interview. I think these would be sufficient for the petitioner. The background check performed before it reaches the consulate and tax information required for the interview should show you are single. Plus, if you have been single all your life, there should be nothing in your records contrary to this. As another poster mentioned, my fiancee will have to acquire a CENOMAR(certificate of no marriage) from the Philippine government. This is a country specific requirement for her interview.

This is the form to get married in China. A K-1 is completely different.

They are required at countries that have them....the US has no such animal.

Affidavit of Eligibility to Marry

All civil law countries require proof of legal capacity to enter into a marriage contract in the form of certification by competent authority that no impediment exists to the marriage. No such document exists in the United States. Unless the foreign authorities will allow such a statement to be executed before one of their consular officials in the United States, it will be necessary for the parties to a prospective marriage abroad to execute an affidavit at the American embassy or consulate in the country in which the marriage will occur stating that they are free to marry. This is called an affidavit of eligibility to marry and the fee for the American consular officer''s certification of the affidavit is $55.00, subject to change. Some countries also require witnesses who will execute affidavits to the effect that the parties are free to marry.

Your fiancee will have to produce a certificate showing her marital status ( even if she has never married ) because she is of marriage age in her country and they require the certificate for marriage! That is one of the items listed on the OF-169 for Guangzhou that she must provide for her interview! You will not need one because you are seeking a Fiancee Visa ( K-1 ) for her to enter the United States to marry and as shown above the US has no such document.

Education is what you get from reading the small print. Experience is what you get from not reading it.
