Hi all,

I need some help. I have just recieved my packet 4 and my interview is in a month and not 2 weeks like I was expecting (apparently Sydney only interviews once a week!!!)

I need to travel back to the states before this because my wedding is booked and paid for and i believed i had more than enough time to complete this process If I abandon my K1 visa what will happen when I enter the states again??

Well, that's unfortunate. If you abandon the process before receiving the visa, then you'll have to file for the spousal visa (IR-1/CR-1) and start back at square one.

So, you can go to the US and assuming you're admitted with no issues, get married, but then you must return to your home country. However, since you're clearly coming with the intent to marry, there is a risk that you may not be allowed in the country, so if you're going to keep your wedding plans, bring rock solid ties to your home country that show you will be returning home.

Reminder to others who may be reading this thread, do not book/reserve/finalize any plans until you have received the visa and it's in your possession.

Thanks for this, I do work for a cruise line and would be returning for work. Do you think my entry may still be denied??

There's always that chance. The best you can do is bring rock solid proof that you will not be staying in the country. Get a letter from your employer stating that you must return to work by X date.

I do enter with a confirmation of employment and that has a start date on it so that in itself is rock solid proof I'm leaving the country. Thanks

I would first try emailing the consulate to ask that the interview be brought forward due to your wedding being booked. They might not bring it forward (someone requested it recently) but it certainly doesn't hurt to try. You could try attaching proof of receipts etc that show you MUST be there

ALTERNATIVELY, and in my personal opinion the best option, is do not make this wedding your legal wedding. Do the wedding but DO NOT sign anything making it official. Then you can continue with the K1, come over to the US, get married in a court house and it'll all be dandy. Seeing the "wedding" will be in the US it's easy enough for them to check that it wasn't valid.

I have already emailed and asked for it to be moved forward because of the wedding however I haven't heard anything as of yet?? Do you know if they granted the one that was requested??

Sorry I thought I said. It was denied. That person had a flight booked but changing a flight is easier than changing a wedding. They might be trying to see what they can do so that might be why they haven't replied yet. Give it a little bit longer. The person that was denied heard back immediately.

Great news!! They have given me a new date for May 1st which is amazing. I now have to have my fingers crossed that I can pick up the visa from the consulate the day of the interview or the next day. Has anyone out there been able to pick there visa up on the day before???

Not out of the woods yet but we're on the right track!!

The visa is mailed. You will have to leave your passport and it usually takes about a week. Although, someone recently had issues and it did take longer. It doesn't hurt to ask but I haven't heard of anyone, recently, that has been able to pick it up. Fingers crossed for you.

OUR JOURNEY SO FAR: (dd/mm/yyyy)

18/09/09 - CR1 NOA1

16/07/10 - POE LAX (256 days NOA1 to interview)

27/09/10 - Aussie/American bun in the oven due May 10, 2011

06/01/11 - Submitted change of address online to USCIS. Mailed I-865 for sponsor. Neverending!

05/05/11 - Bouncing baby boy arrives

10/07/12 - Sent I-751

13/07/12 - I-751 NOA1

Congrats!! Great news :) See doesn't hurt to ask. As was said above the visa is usually mailed out, that's why you have to give them that envelope. You could try asking if you could pick it up, or try asking for them to make sure it's mailed by X date. When do you need it by?
