Hello everyone!

I'd like to get some help here! My boyfriend is a U.S citizen and he's a senior at the university. He doesn't have a stable job yet, therefore his incomes are not that good.

We want to apply for a K1 visa but we're afraid to be rejected because his I-134 Affidavit of Support form is not gonna be good enough.

He and I have been in this long distance relationship for almost 3 years and we'd really like to settle down and live together in the U.S.

What can we do if we don't count with a sponsor?? what's the minimum income he needs??

Your boyfriend can ask someone if they will be a co-sponsor... Perhaps his parents. You will need 125% federal poverty guidelines. (so amount depends on how many people are being supported by the sponsor or co-sponsor)... $18,912 for only 2 people... and it goes up from there.

hhhmmm usually militar they only base the income in the 100% of the poverty guidelines which is $15,130 annually(2)...i don't think he doesn't make that much because even MINIMUM WAGE that works 40 hours per week make that a year...are u sure his telling you the truth??

kinda sound fishy to me...i'm so sorry but it is...sound like his making toooooo much excuse.

sounded like part time military, as he was still also student... not sure if the 100% would be ok here in this case???Perhaps ROTC (is that still around), or Reserves???

she mention the bf work as military so USCIS base it on the 100% poverty guidelines....anyways I read on the USCIS even the I-134 only base on the 100% poverty then after they got married and adjust the status that’s the time they will base it on the 125%(using the I-864 form)....not sure why in this website (visa journey) people base it on the 125% using ONLY the I-134 affidavit support and making everyone confused.

The longer it takes to happen the more you'll appreciate it when it does!

You say he is military, but yet state he is in school and does not have a stable job. What kind of military duty does he do then? You can only go by the 100% poverty level if you are active duty military, and it sounds like this is not the case. He will need 125% of the poverty level for his household size. If he had no dependents, then it would be just himself + you, and he would need $18,912. If he does not make that much in a year, then he needs to find a co-sponsor that makes enough for their own household size + you.

The rationale is if you aren't at the 125% level by the interview, how will you be there in a few months when it's time to adjust status and file the I-864? That's usually why most embassies use the 125% guideline for the I-134 at the interview stage.

The consulate will be forward looking to the 864, to be sure you can adjust status. If you only have 100% at 134, better have a rock solid plan as to how you will be 125% a few months down the road, otherwise you will likely be denied on public charge.

It is simple, and has been stated on this site time and time again. Most consulates still use the guidelines and instructions for the I-864 even when using the I-134 for K-1 applicants. The I-134 is not even a DoS form, and was not created for a K-1 applicant to use. Its purpose was really for those non-immigrant visa applicants that are not intending on staying and adjusting status. The K-1 is technically a non-immigrant visa, but it is special in that those entering the US with a K-1 are intending to stay and immigrate. Consulates know this, and know they need 125% for AOS, so they like to see they meet the requirement before granting them a visa.

There is no confusion. It is 125% or 100% if you are active duty military.
