Hi everyone, I'm new to this forum. I am the woman, the petitioner and I'm 13 years older than my fiance. We have been in love since 2006 and we have a little girl together. He was denied student visa back in 2007, at the time we were not talking about marriage. I just recently filed the fiance petition for him and we have spent a reasonable amount of time together prior to that. I have visited him once from 2007 to 2009 and twice since between 2010 and now. we have lots of pictures and other documents to prove our relationship. Do you all think the age difference and him being denied the student visa would affect our petition even though we have a baby together? Please help us so we can plan better for any kind of questions that may arise during the interview. What more they may need from us and if you've had this type of experience kindly share and it will be appreciated. Thanks.

April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

This is a good question for NigeriaorBust or Patient2010.They really know their stuff. I know they will see this post soon I will alert them to it. All I can tell you is second hand stuff but they know Nigeria, the consulate and all that.

Well just my two cents since we were disussing in another thread age difference for Nigeria. And well you have conquerors the one ting that makes us that are older get denied. You have given him a child. Thats a plus plus. You have lived with each other seen each other alot and have known each other a long time. So your Red Flags have well turned pretty dim. As they say if you can't change a red flag not make it look so flammin red and you have without even knowing.

Timeline

Lagos is the most difficult consulate without a question. Remember that in their minds a child is proof of sex not love. Joseph and I have about the same age difference and we are a bit older. Most Nigerians that have the means have applied for a visitors/student visa and most have been denied so they are used to seeing that pattern. Are you the same race and similar religious back grounds ? That will normally help. You need to show that you are a couple and that you and the child are not an excuse for a green card. It may shound shallow but you are going through a place that probably sees more fraud than any other in the world. You have been there and know that people will kill for a passport with a US visa in it. They will assume the relationship is false and a form of romance scam. You must be willing to show them that they are mistaken. The questions they ask will poke at how well you know each other and share. Some of the questions may be inappropiate, such as when they asked my husband if his father died because he was marrying a white woman.

This will not be over quickly. You will not enjoy this.

Just to add him being denied the student visa will not hurt or help the k1....Your having his child does not gurantee a visa be organized pay attention to detail and like you say remain faithful....Goodluck Lagos is stuff but they have been conquered many times when it come to K1! Oh! I almost forgot to tell you Welcome to VJ! :)
