AOS times and driving licence

Ok, I am confused. We filed our AOS paperwork and received notification in February of that and we have a biometrics appointment booked for next week. However today I finally got my NC driving license and the lady told me that she could only issue a temporary one because I am not a permanent resident yet, and it will only be valid until the KL visa expires. My question is how long is the AOS process going to take (roughly - I guess that may be like saying how long is a piece of string) and also is there another way to get a permanent driving license? If so what documents would you need to show? Hope that makes sense.

5-6 months for the whole AOS process is what it seems to be trending lately. You would use a green card to have a proper license in some states. But some states only issue it to be valid for as long as the green card is valid which would be 2 years.

Sorry my computer is acting up!

In order to get a drivers license that lasts a year, you need your employment authorization card/approval. We did the same thing. My husbands first license was only good for a few months (till his visa expired)and they gave us the year one after we got approved for the I-765.

Now this is in FL so I suppose it could be different in N.C. but thats the answer I've got. Hope it helps!

That's great thanks, I guess a few months is better than none at the moment and I can at least get mobile. Does everyone get called for an interview or it is just random as to if you get called for one?

You'll probably need to go to the DMV to get it updated when you get your EAD, Permanent Residence, Removal of Conditions....

I was only able to get mine once my EAD arrived, it says I'm a Temporary Visitor until this time in 2013, so hopefully it has given plenty of time for USCIS to approve our petition!

My AOS is being dealt with by California Service Center, which seems to indicate I won't need an interview, but you never know.

50/50 chance of interview. Not everyone gets one, some that get sent to CSC sometimes still end up with interviews anyways.

Hey,

I did apply for my D-License too but they gave me a temporary one to expire when my I-94 expires which means valid for only 3days. I couldn't imagine this when my visa will still be valid for 3 more months. Is there any thing that is needed to be done even though have filed my AOS and waiting on decision.

Probably not. Most states need to see you have the EAD or green card. Here in FL my husband got his state ID with his EAD, and it was marked 'TEMPORARY' and valid for only the year his EAD was. When he got his green card, they issued him a normal, non-temporary state ID good for 8 years.

State ID is different to a drivers license - it is just an ID whereas a license allows you to drive as well as being an ID.

Each state differs in how long you can drive using your foreign license, and when you can get a local one. Check with others in Florida.

He got a state ID instead. He does not drive. The document requirements for the state ID and drivers license are the same though. Check out this site. It will let you know what you need to bring with you: http://www.flhsmv.gov/html/dlnew.html

I took my AOS reciept and got a one year licence. I'm in Florida too. I didn't have my EAD (still don't), however, I'm from UK and have a ESTA that doesn't expire till Nov of this year. Hopefully I'll have my conditional by then. Don't worry about the licence expiring, if the worse comes to the worst just renew again. Take EVERYTHING with you as far as documentation is concerned, they asked me for my husbands birth cert... who knew... but I had it with me. Let them ask for what they want and give it to them. It costs money but it keeps you on the road legally.

I've been back and forth for a few years and always used my international UK licence. You can apply soon as you like. But if the visa you present has a short validity, that's what you are going to get in Florida. If you give them your AOS receipt and bumph from USCIS they may give you the year like they did with me.
