After 5 months of waiting... RFE

Timeline

I'm absolutely devastated. We've been tortured for 5 months waiting for Colin's green card. Now we get an RFE. I won't be able to sleep until I see exactly what it's for. I can't lose him after waiting so long to finally be together, then to get married and live together for 7 months and have it all end. I'm so sick of this torture.

Why would you lose him.. They just want some more evidence or something was not signed etc. They don't tell him to leave because you got an RFE.

Sorry for being so negative. I've had really really bad luck the last few months. Everything that could go wrong has and I'm not talking little things, I'm talking HUGE things that have happened to me. I'm just scared. He's the only thing that has kept me together the past few months.

It shouldn't take too much longer after you send the RFE documents. I filed on the same day as you and got an RFE on my I-485 after almost 3 months. I didn't get my EAD for over 4 months, since that was suspended while I was in RFE. Since you already got the EAD, this will just be a request for extra evidence, probably something minor like Inky said, and shouldn't hold things up very much.

I've always been afraid of my income. It was barely over what I needed to make to support a family of 4. If we need a co-sponsor, I have no idea who to get. My family wouldn't do it and I don't feel comfortable asking a friend. I'm sorry to be negative. It's just been hard.

We also were RFE after 4 months of the waiting and I also was just at income level, but i had a co sponsor waiting if needed. We were RFE on income so I have sent in the Co sponsor I-864 , ( thank goodness for my wonderful sister and brother-n-law). When we got the RFE we had all the paperwork ready and mailed the next day, over nighted.2 days later EAD was issued, then we waited 2 weeks and we now have an interview on April 18th. I am beyond nervous and only hope we have everything we need for interview. I just want to say we VJERS all can sympathize with you on this journey! Best of luck, please try and be calm and know you arent alone.....

You would think that they would not have let him come over in the first place if my income wasn't sufficient. He's been here 7 months now. He got his EAD the beginning of February and started work the next day. We were transferred to CSC for "faster processing". We really thought we were out of the woods for an RFE. I guess not. It's going to be tough for me to find a co-sponsor. I don't have family to speak of besides my retired parents. It's hard to ask a friend to do that for us. I guess I'm going to have to find someone and quick!!!! This is all so stressful.

An RFE can be given at any time even up to and after an interview.

Have you gotten the RFE in the mail yet? how do you know it is because of your income.

Since they take the income I make from my business after expenses, it falls under and I've heard that sometimes they count child support and sometimes they don't. My timeline was similar than yours and i got an RFE last month as they lost my medical exam. I know that RFE are a pain in the butt, and more so if they come after 4-5 months. But the good news is that when i send in my reply to the RFE they approved my case at CSC within a week of them recieveing the package.

So don't be depressed, its highly likely that if you satisfi the RFE requirements that you will get a decision within a month MAX.

I also used child support and she said it was fine and I only have about 4 years left of it. I don't think child support will be a problem, probably just something simple. We had our AOS interview on Jan 17th and received a letter saying a decision could take up to 6 months.... I am sure we are going through name clearance, etc. Good luck...

I know how stressful things are. It took us almost a year to get our K-1 and so now, even little things put me on edge. We got an RFE last week after over 4 months. It was because the civil surgeon did not have my husband sign in front of him (he didn't ask) before he sealed the form (which he should have) up. So we had to go back and have that done, and of course, I am absolutely sick hoping the Civil Surgeon filled out the form and their part right this time and the vaccines, even though it is beyond control. SO much in this process is beyond our control. I think, what if the CS messed up something again, will they deny petition? Another RFE? Just take a deep breath and relax, you have been this far, one way or another you will get through this!
