I-864 which one??

hi guys its our understanding that there is more than one i-864 forms, my husband is the petioner and i am the only one he is sponsoring, there is an i-864 easy and another. which one is the correct i-864 form???

You can go with I864 ez but your husband has to be the only sponsor for you.If ur husband needs a joint sponsor then u have to use a different form.

Incorrect, a petitioner can complete an I-864EZ if they require a joint sponsor for the Affidavit of Support. It is the joint sponsor that can only use the I-864.

OP: A petitioner can only use the I-864EZ if they are able to answer yes to each of the first three questions on the form.

So in the case of use of joint sponsor, the petitioner still completes a I-864/I-864EZ for themself even though they do not meet the poverty income level criteria,

followed by I-864 filed by the joint sponsor, which are then submitted together?

In this case, does the petitioner still submit their most recent tax return?

(we didn't use a joint sponsor....just curious).

One other question about the I-864EZ.

On the first page of the I-864EZ packet, on the instructions under the heading "Who May Use The Form I-864EZ", the third requirement necessary to use this form:

"The income you are using to qualify is based entirely on

your salary or pension and is shown on one or more Forms

W-2 provided by your employer(s) or former employer(s)."

I had 1099 income which I interpreted meant I could not use I-864EZ. However, upon reading further, at the top of Page 5 of the instructions:

"If you provide a photocopy of your tax return(s), you must

include a copy of each and every FormW-2 and Form 1099

that relates to your return(s)."

Does this imply that both W2 and 1099 are acceptable reports of income allowable in the use of I-864EZ?
