hi guys , today its a mix emotion i felt,,! happy & sad ,,,,i am happy because my NOA2 approved & my husband told me the he already file his income tax but he put in his status single , i just read some experience but they put it married that why i am so sad to her that my husband file already income tax that indicate SINGLE ,,may be this is the reason guys why my visa will be denied,,!! plz give me advice of what will my husband do to change the status , :(

If you guys are married, and he filled as single, yes it will be a problem. He can either filed as married filling jointly or married filling separately. Just have him amend his taxes and problem solved.

Please tell your husband to file form 1040x (Amended tax return for Federal and his State. If he is in CA, he needs to file 540x for the state. If he is in a different state,then he need to file the appropriate one for that state.Good luck. You would need copies of tax returns when you go to American Embassy on Roxas Blvd. in Manila when you go to your interview. Good luck.

We were married in December 2011 but my wife filed her taxes in January 2012 as single.

She was told that since I (her husband) am not in the states just yet and do not have a ssn, and to register our marriage in the states I have to be there with her to sign the papers so she cannot file as married filing separately.

I don't really know what is true and what is not. Even the customer service representatives at financial institutes can mislead you and get you in trouble :(

No. You can have a child or get married on December 31 and still file as married or file the child as a dependent for the tax year.

we got married July 4, 2011, and yes my husband's income tax return for 2011 is still SINGLE, its because they need the Visa and SS number which at present i dont have it yet. one thing more my son and me have have to different case, will they processed our application separately or they are together. . . please enlighten me about this . . thanks friends

Yes, even for the child tax credit and earned income credit.

Death or birth of child.

The same is true if the child was born or died during the year, except for any required hospital stay.

As sheeshkabelle said, this is wrong. If you are married Dec. 31, 2011, then you are married for all of 2011.

You do not need a SSN or the spouse's signature to file married separately. You do need a SSN or ITIN and the spouse's signature to file married jointly.

You do not need a visa or a SSN to file married separately or jointly. Your husband needs to file as married, whether that is separately (without a SSN/ITIN for you and without your signature) or jointly (with an ITIN for you, plus your signature on the 1040, plus a declaration saying you want to be treated as a resident for tax purposes, plus the form that excludes any of your foreign income).

Married people are not eligible to file as single. He needs to amend to either head of household (if he has dependents) or married filing separately/jointly.

Head of household and single are two different filing statuses. A married person can file head of household if they qualify. They can't file as single.

Also, a SSN isn't necessary to file as married. A SSN OR ITIN is necessary for married filing jointly. One can also file as married filing separately and simply write "foreign spouse" or "nonresident alien" in place of their spouses social, depending on the situation.

First you don't register a marriage in the US. You're married, that's that, no matter where or how you were married.

It's very easy to amend tax returns, and people filing single and not married or head of household better do it quick! The IRS is going to figure it out eventually and not be happy. And I'm sure when the returns are submitted for the I-864 and NVC looks at them, their not going to be happy either.

I don't know how it works but that is what a tax preparing / filing company called H&R Block told my wife and believing them she filed her taxes as "Single".

Do an amended return and see a real accountant to fix this if you need to.Looking at your time line i am assumeing you are not in us? Maybe this applys http://www.irs.gov/businesses/small/international/article/0,,id=96696,00.html get at tin #. Call the IRS and ask.
