Haven't checked in for a while and wanted to see how everyone was doing. Rong and David...thank goodness you are finally making progress! I hope everything from here on out goes more smoothly. You deserved it!

Res....so sorry to hear what happened. As it turns out, my luck is no better than yours. My husband and I are separated and getting divorced. I wish it would have happened before we went through this whole process though. I look back at where we were a year ago...so excited and waiting everyday for our interview..and now here we are. :( We love each other still but it is impossible for us to live together. Some of it is cultural but most of it is...well...it's a long story but the problem prevents me from living with him. It is just constant fighting all time. It was so bad, I took a job back in Afghanistan which is where I am now.

Anyway....

This brings me to a question for you all: We have not yet had our AOS interview. Milan would like to stay in the US and I have no problem with this. I just don't want to be financially and legally responsible for him. I agreed to go to his interview and see if he will be allowed to receive a green card based on our current situation. I will NOT, however, go to the interview and lie or pretend that we are happily married. This to me is fraud. Our attorney is aware that I will file for divorce as soon as his interview is over. He says that "as long as we entered in the marriage in good faith (and we absolutely did) , it doesn't matter if we are divorcing. They should still adjust his status".

Why does this not sound right to me?

I tried researching but really couldn't come up with a straight answer to this question; Will he still be able to Adjust Status or will he be denied based on the fact we are getting divorced?

Pam, I am really sorry that things haven't worked out for you.

As for the AOS interview, I am not an expert, but here is what I think. First of all, don't ever lie to immigration. At the AOS interview, you will have to swear an oath, so as you can imagine, you will both get into major trouble if you do not tell them the truth. My assumption is that if you tell them you are separating and filing for divorce, they will assume that the marriage is for immigration purposes only and deny the AOS application.

Even if it worked out - if you say you don't want to be financially responsible for him, I don't think you can revoke the I-864 without revoking his Green Card. As far as I have gathered, the I-864 can only be withdrawn BEFORE the GC has been issued and will automatically lead to a denial of the AOS application. Of course, your husband might get lucky and be one of the interview waiver cases, but I wouldn't count on it.

Maybe ask your question in the general forum, and you might get more qualified answers.

So sorry to hear what's going on Pam... I agree with above...you can withdraw the AOS but you'd have to do it before the GC is issued. You cannot do it afterwards. I agree that you have to be truthful. I don't know else to say except that you'd probably get more helpful answers if you made a separate post in the family changes forum.

Pam, I hope this is just a bump in your life, and that you do find the right one eventually. In any case, I COMPLETELY agree with what HK12 has put above. If it feels wrong to you, it is! You need to think of your life now... and your future. Do not entangle it any more from this point forward. Seriously...

Well, we are moving forward, thank god we only have to do this part of the process once. I know there's more waiting after she gets here, but I could wait 100 years with her easier than another day without her.

As of september 17, Our package has been sent from NVC to Guangzhou. I'm hoping we'll hear something from them in a couple days. :)

Just a note to let everyone know that I am currently sitting in Guangzhou with my fiance. She had her interview yesterday. She was told to expect her visa in 10 days!

I can very happily say this bumpy part of our road is oficially over.

Looks like I'm the last one in here so don't worry ya'll ...... I'll get the lights.
