I filed for 3 Family Members

Hi Vjers , So its been a few years now since I actually was on the site concerning my K1 Visa & just so u guys know that I was thankful for all the help & advice that I received on this website ,just an update that I'm Happily Married & also I recently became a US Citizen in August 2011 anyways the reason why I'm back on VJ is because I filed 3 petitions for my family , 2 for my parents & 1 for my little brother who is only 13 yrs old .

So Far I've only received the first NOA for all 3 petitions in August 2011 , I'm not too worried about my parents petitions that I filed but I do have a little concern about the one petition I filed for my little brother , I know he is under 18 & I would like to know if he would be able to come with my parents or does he have to wait back for a few more years until he gets approved ?

I'm not sure if there is anyone out there from Guyana that is going through the same process as I am right now , if so please give me some advice because I keep thinking of my little brother being left behind with no family to take care of him .

unfortunatly, the wait for siblings is over 10 years, he cannot come with them because he isn't a derivative of your parent's petition. now are they going to leave him behind, have they provided for him to live with a relative?

now when they become LPR, and come to the US, your mother or father can file for him, but the wait is over 2 years.

another solution is for one of them to come and the other can stay. for example you file for your father, and then your brother can stay with your mother over there. then your father can file for both of them, and they will come in over 2 to 3 years.

yes petitions can go really fast especially if you are ready for the NVC stage. mine took 4months really but entered the 5th month when my mom missed her interview. That said, your sibling will be left behind due to the wait times for siblings which is about 8-10 years.

You could abandon one parent process( lose money etc) so your sibling can be looked after or

proceed with both parents petition and when they are approved , have one of them file for him and in the meanwhile one of them can always go back and forth to check on the kid until he comes over.

Another option is have a trusted family member/relative look after him for the few years it will take ur parent to file and bring him over or put him in a boarding school ( that way he is watched over for most of the year).

Aleful is correct. Your parents are immediate relatives - visa category IR5. A visa number will be available for them as soon as their petitions are approved. Your brother is in a family preference category - F4. Once his petition is approved then he'll have to wait until there's a visa number available, which is currently about 10 years. It would be substantially faster if one of your parents petitioned for him after they arrive in the US and get their green card.

Unfortunately, the timing sort of works against you here. If one of your parents decides to stay in Guyana with your brother then they may lose their chance to get an immigrant visa. Once your petition arrives at the NVC then the beneficiary has one year to act on it. If one of them stays in Guyana until your brother's priority date is current then their IR5 petition is going to be considered to have been abandoned. On the other hand, both parents could come to the US and get their green cards, and one could return to Guyana to wait with your brother. The problem is that a permanent resident can't stay outside the US for more than a year without a reentry permit, nor more than two years even with a reentry permit. Maybe your parents could swap places every six months or so.

BTW, thanks for coming back and updating us on your journey. A lot of people don't come back to VJ unless their relationship has train wrecked, and they're trying to figure out how to get or keep their green card, or how to get their estranged spouse deported. It's reassuring to hear from a success story! :thumbs:
