Visiting Fiance whilst K1 is Pending

Timeline

My fiance is in the USAF and is being deployed to Guam.

I have heard that during the K1 Visa process, I am unable to enter USA.

Guam is considered a US territory - does this mean that I am unable to enter whilst the K1 process is pending?

26 Jan 2011 - Had a 5 hour long conversation that changed my life!

05 Feb 2011 - We decided to be an exclusive relationship

29 Jun 2011 - We met for the first time. It was exactly as I knew it would be!

14 Jul 2011 - He had to leave to go back to USA

17 Jul 2011 - Booked flights for me to go to USA for 3 months on VWP

29 Nov 2011 - Arrived in USA

25 Dec 2011 - HE PROPOSED!

21 Feb 2012 - Left USA for Australia

You ARE allowed to visit during your K1.

I had the same question when I planned my trip.

I was told bring lots of "ties to home" , have travel insurance for the time of your trip, do not over pack, bring your NOA1/2, DO NOT get married on this trip unless you want to start the CR1 process and abandon the k1 process and bring anything else you think is important to prove you are not trying to stay there, but I doubt they will think you are trying to stay in Guam.

My fiance's uncle is an immigration lawyer and that was what he told us, however, I did remember seeing that you were able to when I researched on the web. Just thought I'd clarify and I'm so glad someone else has done the same so it puts my mind at ease!

Might want to reconsider taking advise from an attorney if his actual words were "unable" or "not legal". It's a different matter had he told you that some people have issues at the airport, and a percentage of those are refused/denied entry based on their lack of ties to home country(no job, relatives, very little to return to) or too many ties to the US(a fiancee, spouse etc.). Not everybody gets asked about that at POE.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

As frustrating as this must be, it's a very high-class problem. Beneficiaries from some countries don't have a prayer of obtaining a visitor's visa, and they're often treated rudely at their consular interview for same.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

True indeed, I don't condone of the aggressive(rude) behavior that it seems some are being treated with.

"not everybody gets asked" can go in a negative or positive direction. I've read quite a few of those, and on my connecting flights(before boarding plane to US) seen travelers being informed about POE; that being let on a plane doesn't automatically gain them access to the US.

So my advise is to just answer the questions truthfully , don't give any extra details except they ask you.
