What is the procedure for F4 category visa for unmerried over 21 years old ?

hi ,

I am from India and my brother filed of my family in 2001 and now the peocedure is in the motion mode but the problem is that my daughter is now 25 years old and the rule is carrying family memers who are under 21 years ......?

So I am in big trouble . How can i file of her........?

To clarify, is your daughter 25 and married?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

First give us some more information on your case like when was your case filed and when did your I-130 petition got approved?with this we can know whether ur daughter is eligible for CSPA rule..Even if your petition was filed in 2001 but got approved very late, then the number of years taken for approval can be deducted from your daughter's age, which will be beneficial for you to file for her as a derivative beneficiary..:yes:

Your daughter has aged out. However, she may still be eligible for an immigration visa if her CSPA age is under 21.

To figure out her CSPA age, you will need to know when the I-130 was approved and sent to the NVC. Then follow this link to calculate your daughter's CSPA age; http://www.visajourney.com/forums/topic/110854-child-aging-out-cspa-may-help/
