Any February 2012 filers?

Ok I've written and rewritten this a few times to I can monitor what I'm saying lol

Well today has been hell. Alan went to court for a hearing to allow his boys to move. For THREE years now he's been asking child services so investigate his ex and speak with the children. Till now, they had her self report on how she feels and how her anger issues have been resolved (seriously???). They spoke with the children once, for 10 minutes, in a room with Alan's entire family (and me) there. They got nothing from the kids cause they were scared of this strange woman coming in and just asking them random stuff. It ended with the courts appointing supervised visitation (with her parents supervising??)every other weekend with 4 hrs unsupervised once a week. When we knew we wanted to move, we held off filing until we were sure we had things in our favor. We filed the 129F at his solicitor's direction. He said that concrete plans would be best to have when requesting approval to move the boys.

A few months ago, we submitted to his solicitor a huge packet (100+ pages) explaining why it's in the best interests for everyone if they move here. It detailed our jobs and family situations, contact, visitation, schools, living arrangements, etc. We even priced out internet options for his ex, offered rooming options for her visits and suggested she make a visit to the states to see the area. Now after all this time, the courts have decided to investigate the case and meet with the kids. We have to draw up new statements (one from him, me and his ex) as to why we think our arrangements are for the best of the family. They will be doing police checks on me too. Apparently this is a VERY lengthy process because they set the next court date for October! This sent me into full panic mode and had me convinced we'd have to withdraw our 129F.

Alan held it together and called the Embassy. He got a great woman who researched for him and got him an email code to use for follow up and keep the paper trail going. She said to not pull the petition, but to find ways to drag out the process. I already think we'll get an RFE for not sending an original signature (grabbed the wrong pile when I mailed it, oops). So I'll take a few weeks to get that in to them. I'll be praying we get that RFE and that one of you can have the earlier approval date :) Then once we hit the London stage, they're slow now anyway. She told us to initially only send in our new letters of intent to London, and enclose a cover letter stating the updates on the case and next court date then ask to extend our 4 months due to the extenuating circumstances. Once we have that in, and hopefully get a reply, we can proceed with the court date, then the medical and interview. Hopefully, they'll make a decision at the October date and not push it back again. If she doesn't agree then it gets turned over to the courts to decide what is best for the kids. Looks like I may be making a trip over there in the fall. There is the chance that she will just sign the paperwork once she has all of the information and looks it over. But I've been burned by the UK system too many times to be really optimistic.

Awww, Meg, I'm sorry to hear that! What is wrong with people and/or the courts? I'm hoping for the best possible outcome. With all of us so impatient to get our loved ones over here as soon as possible, it must be agonizing to think about actually lengthening the process just because of someone else's ineptitude. :o

In other news, what on earth was going on with that JULY petition that got approved today at VSC? The RFE was in November, so it should have gone through shortly thereafter. Let's get ready for the estimates to be wonky for a while...

I am wondering why some of RFE take so long time after bieng received by USCIS to make a deceision on?!!!!! Some applicants took them 2-3 weeks from sending their RFE until their NOA2. Others took 2-3 months !!!!!!!!!!!!!!!!!!!!

Well, we don't know how long it took the petitioner to return the requested evidence once USCIS asked for it. Their timeline also lists "RFE Reply(s)" on 12/14, but maybe there were other unusual circumstances in the interim?

Oooh, I just searched for posts by that petitioner, and there were actually TWO RFEs. Here are the posts:

Hello Alla! I just want to ask you a question regarding my situation. Filed July 25,2011..got an Rfe then filed an expedite twice and the second time just this recently and I think twas denied. Then we got another RFE this April 18 , they needed 2 passport-style photos of my fiance (petitioner) of which we submitted when we filed our petition. Can you give me a reason why they needed another 2? And on April 27 they received those photos and asked us to wait again for at least 60 days?

Wow. Not your garden-variety case, anyway.

Losing documents by USCIS could happen. We mail our packages to Texas then they open them and rout them to either VSC or CSC by mail. During that transition certain documents, such as passport photos, could be lost. So by the time these packages reach VSC or CSC, they could be without certain document, and whoever is handling these packages will think that the applicant forgot to sumbit these documents along with their applications. I started getting worried about my 27 pictures that I sent to Texas, along with my application ,as a proof of meeting in person with my fiancee'. Lord have mercy upon us all.

Oh no Meg - I am so sorry to hear about all the extra stress! :-( Please - vent away! That's what we're here for... I have researched some UK laws regarding child support and it just made my head spin - I can't even imagine all that you are both dealing with. Fingers crossed it all goes as smoothly as possible! Chin up!

I know it's a burden, but I will offer to relieve you of that earlier NOA2 date. I suppose SOMEONE has to take it. ;-)

Thanks for the encouragement guys! We so expected her to have seen the papers already and sign off on them. The last court date ended with her saying that if we could answer her questions and concerns, she would most likely agree. We so went above and beyond with this packet and offers of assistance. I've spent the day trying to keep busy and not think too much. If I start thinking, I start crying again and that's really not going to help. I just wanted to crawl under a rock today but am swamped with paperwork from my 2 jobs. I did find one silver lining to all of this though. I've got more time to get some weight off before the wedding. Hey, I'll look for any positive I can right now :) I'm so glad the woman at the embassy was very understanding. She even went to look up stuff, speak with someone and made sure Alan had an email code and was entered in their system so they would have proof of us contacting them about this as soon as we found out. I totally expected a "sucks to be you" type reply. As much as it sucks to have to wait longer, I'll do whatever I need to do to get them here for good.

Haha oh I'm sure you look fine and that he'd love you even if you were all saggy and wearing a burlap sack :) As for me, I'll be getting on the diet in about 10 days, know it won't happen with an out of town friend visiting heh.

I think it will be useful to start planning so that the paperwork doesn't pile up.

I tend to think that it does differ depending on the embassy. From what I know, in RU we are bringing everything to the interview. There is no BEFORE but in other countries people are talking about mailing their documents..
