I think we had a mistake on filling up the AOS for spouse.My husband (USC), file our I-130 and he used the form I-134.do will have a problem on that? what do u think we need to do now? Because, according to him, we only need to use the form I-864 when filing for change of status. Is it correct? I am confuse, pls need some help.Thank you all, in advance.Before i forget its almost 3 1/2 months, after we got the NOA1

What are you filing for - you are posting in the removal of conditions forum but talking about Adjustment of status which are two completely different things.

But then you talk about filing an I-130 and I-134, the I-134 has nothing to do with filing adjustment of status and if you entered on a K-1 then the I-130 has nothing to do with it either.

Your timeline is not finished and shows you filed for a K-3 ??

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The 134 is an affidavit of support document which is in addition to the petition.

No its not. AOS is done with an I-864. The I-134 is done with a K-1 petition.

ok - so filing for CR-1

You are asking abuot the I-864? That's submitted to NVC during the NVC Document Intake Process.

If he filed the I-134 WITH the I-130 for the USCIS document intake process - don't worrry - USCIS will ignore the I-134.

Have your petiotioner come opn VJ and look at the Guides, they seem confused. The I-134 is used for the K1 fiance visa, not the CR-1 spousal visa. There is no adjustment of status for the CR-1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
