I was hoping someone might be able to answer. My husband and I just got our marriage certificate and when picking it up we noticed that they misspelled my husband's last name - They interchanged the letters- (should be- ..TR and they wrote .. RT )

We put in the request for the name change but they told us that could take up to 3-4 months. Issue is that we want to apply for his AOS paperwork soon. We have a copy of the signed name adjustment request form too. I am wondering if applying for his AOS Paperwork will be an issue. Hoping someone has the aanswer

When we applied for our marriage license, the woman accidentally misspelled a name and ALL she had to do was go into the screen and fix it...took TWO seconds. I don't understand the 3-4 months AT ALL. It's their error, and they should fix it "immediately". Talk to someone else and put your foot down. Literally, I saw how it works "here" not sure where you live, but I really don't understand the 3-4 month wait. It's all computerized...what's the issue? They should just be able to change the name and "reprint it". I was there when they printed our certificates, and it's not that hard to change the name unless there's other paperwork involved????? Again, I am only going by MY experience, and how they do it here. Maybe someone else can chime in, but I wouldn't take that answer they gave you. No wayyyyyyyy.

Thank You. The problem is that the incorrect name is not just on the marriage license but On the actual official US Marriage Certificate...and that is why they are saying it might take a while. I called customer service # mentioned on the USCIS site and lady said its not an issue and just submit proof for name change or just indicate but i still have a little skeptical.

Thank you though :)

There is no US marriage certificate, only the one from the State or county you were married in. Each state is different in how they handle changes or mistakes. Three months seems way too long. Here in Georgia, my wife found a mistake on our marriage license and we went to the county clerk and they fixed it on the spot. Maybe five minutes. Again, though, each state (county) may be different.

Some states can take 3 months (or longer) to do this. Hawaii for example.

Information from the 1-800 customer service is not reliable. There have been several examples of them causing problems because of incorrect information, and sometimes even egregiously bad advice. If you need to file before you have the corrected certificate, it would be a better idea to schedule an infopass appt to get a reliable answer.

IMO they may not make an issue of this, but they certainly could. If you file now you would be taking a chance. If you get a RFE and you have the correct certificate in hand you could send it in and have saved time. If it ends up that you get a RFE and don't have the correct certificate in time, you may have ended up wasting time and money.

Put the incorrect certificate in the file with the application to correct it. Cover them both with a BRIEF letter.

Our journey together on this earth has come to an end.

I will see you one day again, my love.

I think they didn't notice the misspell on the marriage LICENSE back then. So they got married and now they noticed the misspell on the marriage CERTIFICATE.

I think you should go to the marriage license office and talk to the person directly.
