Hello everyone, so I got a name change after I got married to my fiance. we are now filling the application for AOS for him and I have so many questions. First should I change my name in my passport and then apply for AOS or not, second do I put my new name or my old name my husbands AOS application?

I am so confused about things to do after getting a marriage name change and how it will effect AOS.

You can use your husband's last name on your aos application. Just a reminder, it is your aos application and your husband is the petitioner. The name that you put on you aos application is the same name that will appear on your green card. Goodluck!

thank you for the replay but I am applying for my husband. I am the petitioner not him, so should I put my new last name on his application?

Yes, put your new last name. However, the non-USC (i.e. your husband, right?) is the petitioner at the AOS stage. The USC doesn't petition for their foreign spouse, the foreign spouse petitions for him/herself.

No. He is the sponsor, the OP (the immigrant) is the applicant.

You WERE the petitioner, now you are the sponsor. HE is the applicant. If you have taken his last name that is now your legal name.

No, APPLIES for himself. it's not a petition. The immigrant is applying for AOS, they are the applicant. The USC is the sponsor.
