This has probably been asked 1,000 times and if so, then I am sorry...but I'm new to this whole Visa thing!

We are working on getting the K-1 right now, but my fiancee is a workerbee and the first question in her head is always - how soon can I start to work?

We had talked about waiting a while to marry, maybe close to the 90 days....If we did decide to go that route, can she still work on getting approval to work? I've read that the EAD is the go-ahead to work, but does the EAD require marriage first?

Just basic questions I guess. Sorry if these are naive!!!

K1 Process -

1/30/12 - I-129F sent

2/2/12 - NOA1 Received (CSC)

2/3/12 - Visa App Fee Check Cashed

6/18/12 - NOA2 Email Received at 9PM MST

6/22/12 - NOA2 Letter Received in Mail

7/11/12 - NVC Received

7/13/12 - NVC Sent Case to Moldova Embassy

7/18/12 - Packet 3 dropped off to Embassy

7/19/12 - Packet 3 & 4 Instructions Received from Embassy

7/23/12 - Medical Exam Passed

7/27/12 - Interview

8/4/12 - POE Denver, CO

9/14/12 - Wedding #1 (Denver Courthouse)

9/17/12 - AOS/EAD sent

9/19/12 - AOS/EAD NOA1

If she wanted to work right away a CR-1 would have been more appropriate.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You will need to be married first, then file for AOS and include the applications for EAD and AP at no extra cost. It takes about 3 months to receive the EAD/AP combo card to be able to work and travel while waiting for the green card.

You CAN file for an EAD before marriage and filing for AOS, BUT it will cost $380 and be pretty much useless. It will only be good until your I-94 expires, and it takes about those entire 90 days to receive the EAD. It would be a waste of money.

I suggest volunteer work to keep her busy and pad her resume while waiting for the EAD and green card after you are married and she files for AOS.

Technically, a k-1 can apply for an EAD immediately. It's pointless, though, because the EAD is only valid until the I-94 expires (90 days) and it takes about 70 days to receive. Plus, when filed prior to AOS, it isn't free. So you're looking at hundreds of dollars and then being able to work a couple weeks at most before having to stop.

If you file with AOS it is free and will take 2-3 months again to receive.

Alternately if you haven't started the K-1 yet you can marry and file for a CR-1. Processing times are similar and the immigrant enters the country as an LPR making them eligible to work from day one.

11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC

Thanks for the answers! I will talk about these solutions with her. The volunteer work is a great idea though, especially because she is a teacher already (she teaches English in Moldova) and she'd really love to teach in the states - maybe kindergarten level or something...
