I am currently visiting my fiance in the US and we are filling out and double checking all the forms and information to send off for the start of the K1 visa process. QUESTION 12. Is your fiance currently in the US? Yes, I am but I did not need a I-94 form to enter the US so didn't fill one out. Will the consulate identify this as a UK citizen I entered the US through the ESTA visa waiver scheme? Should I state 'yes' and explain with the visa waiver in the answer box?

i would put that as a no, you're just visiting and the way i see it the question basically means is the person living in the us

Be totally truthful. Check YES, then explain and like the other poster mentioned put the date you are intending to leave.

You see it wrong. Read carefully, interpret literally "in the US" is not the same as "residing in the USA"

He should answer YES if he is present in the USA when he files the form. USCIS is fully aware of the VWP, it will be nothing new to them.

I was in the same situation and put something like None (Visa Waiver Programme). Submitted just a few weeks ago, so can't say for sure it didn't cause any problems, but seemed the simplest, most honest answer.

K1

10 Jan 2012: I-129F package sent

14 June 2012: NOA2

11 July 2012: Medical

30 July 2012: Interview at London Embassy (Approved!)

13 Aug 2012: Visa Received

1 Sept 2012: POE (Atlanta)

15 Sept 2012: Wedding in New Orleans

AOS

16 Nov 2012: NOA Receipt Date

20 Dec 2012: Biometrics Appointment

16 Jan 2013: EAD & AP approved

25 Jan 2013: EAD & AP Card received

I was in the USA during xmas when we filed our I-129F

I remember we ticked YES and left the I-94 number blank and wrote in the box

Visitor on VWP (ESTA)

see passport page xx

The passport page shows the US entry stamp, I only stayed for 14 days but they gave me 3 months stamp.

I agree, answer Yes and then state VWP. The USCIS will determine that UK visitors won't have a I-94. There will be no harm to answering truthfulling and tons of potential harm is you do not.
