ouf, my wife called them, they say they are not going to mail us back the IV package, they will keep it safe for us until the payment is made. My wife is going to call the bank right now to have everything fixed. I am sure it is something from the bank. They lady over the phone told my wife it could be a wrong number put while i was filling the transaction process. I do not agree with that, the system would not show paid if there were a wrong number as information,.

Actually my lawyer does not have much idea of what he is doing. He did not want to send the package because he said I had to wait for NVC to send me something by mail. And thanks to VJ I also discovered that I was no longer K-3, and had to prove to my lawyer that the k-3 was administratively closed since both I130 and I129F petitions were approved together. What makes me upset about all this is that I paid expensive money for this lawyer and he showed me he is not updated on the visa procedures. And now I am doing everything alone. But he need to send it because the DS 3032 is in his name :( ... But i have faith in God we will survive!!!!

If you didn't want your lawyer any longer, you could have taken him off your case, sent a DS-3032 in the petitioner's (or beneficiary's) name and sent the packages yourself. Just because you started with a lawyer doesn't mean you have to keep him the entire time. Many people drop their lawyer at some point in the process because they realise they don't need them for the amount they're charging. Plus, you can get most, if not all, questions answered here on VJ.

Oh, in your last post, it sounded like your lawyer knew what he was doing, but it seems not with your above post.

If you didn't want your lawyer any longer, you could have taken him off your case, sent a DS-3032 in the petitioner's (or beneficiary's) name and sent the packages yourself. Just because you started with a lawyer doesn't mean you have to keep him the entire time. Many people drop their lawyer at some point in the process because they realise they don't need them for the amount they're charging. Plus, you can get most, if not all, questions answered here on VJ.

100% agree with Saylin, I would drop him off. But this is your call.

If you didn't want your lawyer any longer, you could have taken him off your case, sent a DS-3032 in the petitioner's (or beneficiary's) name and sent the packages yourself. Just because you started with a lawyer doesn't mean you have to keep him the entire time. Many people drop their lawyer at some point in the process because they realise they don't need them for the amount they're charging. Plus, you can get most, if not all, questions answered here on VJ.

My wife just call the bank and the money was returned back to her account. The lady at the bank asked my wife to double check with the routning number and bank account number. It more likely seem that the problem is on my wife side. She texted me probably a wrong number. better that than worse.

Sounds like your lawyer is just slowing your case down (as is typical with most cases with a lawyer). Honestly, I'm sure you two can handle this on your own. All that's left is to wait for a case complete (unless you're missing documents, in which you just mail back what they request). Then you wait for an interview letter, have a medical done, and attend the interview. There's not much else the lawyer has to do at this point.

IMO, I'd say drop him, inform NVC of this change, and in return, you'll save money for the medical and the move to the US :)

That's what I did. I only hired my lawyer for the the first part (I-130) of the process. He never called USCIS regarding the status of my petition that took 6.5months to approve. I was doing all the calling, his work basically. After my petition was approved and reading the VJ forums, I told him that I didn't need his service anymore. So, I did my AOS and IV packages on my own with the help of VJ members. Thank you guys -you saved a couple hundred dollars :D

This seems pretty typical of most people's experience. The lawyer ends up costing hundreds and hundreds of dollars and just slows the process down. After all, no one on Earth cares about your case like you do. So, people pay lots of money and then end up often having to fill out most of the paper work and do most of the leg work themselves.

In my opinion, the only point where it makes sense to hire a lawyer is if you have to fight a consulate's bad decision.

This seems pretty typical of most people's experience. The lawyer ends up costing hundreds and hundreds of dollars and just slows the process down. In my opinion, the only point where it makes sense to hire a lawyer is if you have to fight a consulate's bad decision.

Another benefit of having a lawyer is that since the lawyer is automatically designated as the agent for the case, no DS-3032 has to be submitted, so the AOS and IV fees are invoiced at the same time, so you shave off a few days.

But, most lawyers slow down the process by taking their time (as they don't place the same importance as the petitioner/beneficiary), so in the end, having a lawyer isn't really beneficial, unless your case is complex.

I suspect any slight savings with having a lawyer would quickly be wiped out by them not being up to speed and insisting that they know the process better than anyone else. I even run into that sometimes when talking to my Congressman's immigration guy. He'll insist that I have to wait for NVC to do this or that and that I should just be prepared to take 3 - 4 or more months in NVC. I keep having to tell him that no.. that isn't normal these days if you're on the ball and pushing them down the path.

The one time I've had to use a lawyer for anything, it quickly became apparent that in any remotely simple situation the job of the lawyer is to fill out paperwork (which you could do yourself) and make things take far longer than they otherwise would have. :D

Side note, my daily call to NVC resulted in the same thing as yesterday. "Your case is being reviewed by a supervisor"

I'm wondering if they're really doing that or just telling me that to make me go away. AVR still gives me the case number message indicating we're still at step 0.

I wonder if actually trying to speak to a supervisor later today would yield anything interesting or just another form of blow off?
