I feel like my husband is being fooled by uscis

She is from his previous marriage. He has most of the custody of her. Im gonna be clear his family sucks his brother has 4 kids while cannot afford having that many, his dad in not present he never met him, his mom is disabled.

more back story:

I am new here and need some help.

I have been living in the US since september 2005 when i went as an au pair did that for two years got into college and was with an F-1 visa until I married my husband in may 2011. I had complications with my pregnancy and our baby was born july 2011 with some health issues and a lot of hospital stays so I did not send my papers in. Now december my daughter was addmited again and my mother was really sick so i had to leave the US with my daughter in the hopes of getting a second opinion and help with her issue. I called the costumer service hotline before i left and explained my situation. They said my husband would have to file the I-130 petition, wait to be approved and then the consulate would call em for an interview. Well they never said that i would have to do my green card journey here and that it could take up to 5 months. I really did not want to take my daughter away from her dad for that long. Since i am married in the US and have a US CITIZEN DAUGHTER is it possible that my process could be faster? we were living together since december 09 in the same house , have cars and other things in our names. How do I go from here? Have him file the I-130 and then what kind of visa would i be getting? the greencard would be sent to my house in the US or I would receive it here?

LOL.. i am the wife but thank you .... i understand the sick child thing too... we had a baby at 18 months with brain surgery due to a cyst in her head. We were given no chance of survival if she didnt have surgery and 50/50 if she did. But she's fine now so God will take care of all of you just have faith.

Are the people suggesting that she sends her six month old baby to the US without her parents?? As a mother (and yes I do have a sick child myself) I would be beside myself if I was seperated from my young baby indefinitely and even more so if she was sick and possibly having to under go medical proceedures! I'm not dismissing all the advice etc but I think it is cruel to tell a mother of young baby to suck it up and send your kid off by herself! The child is not in immediate danger in her country but would benefit from the better care in the US. I wouldn't part with my infant either. Have a heart people

This baby is voimting blood, so I don't know what you consider immediate care. The father is in the US, and he isn't by -side of the baby in Brazil. Either way this child right now is only residing with one parent.

nope.

usc dad is in the us. non-usc mom is in brazil with usc baby until the cr1 is approved/issued which is likely to be a number of months.

would you prefer she was only given advice that was warm and fuzzy?

did I say that they shouldn't be together? What I said was it is cruel to imply that she should just let her child go. I am certain that if the Brazilian healthcare system can take care of the child sufficiently to provide a feeding tube, medications and testing that they will be able to keep her alive, not optimal but doable. Having a sick child is stressful and the parents deserve to be together to support each other, neither one of them should have to suffer alone with this. I have been waiting for my visa for a long time also but i don't resent these parents for doing what ever they can to expedite there request and I don't understand why so many people here seem to think it is such a terrible thing. Arn't we supposed to support each other on this journey?

Some people here are heartless and cruel. Yes i have explained why she cannot be in the us alone and i bet those giving advices for me to let my baby go are people that do not have a child. I am all for those people that have serious reasons for expedite go ahead and file. It is not my fault that others have to wait. I wish this was easier on everyone. I have been thru hell and back and i am not going to let anyone tell me i dont have valid reasons. Why dont you ship you baby to the us alone for months and have a nanny care for her ? Lets see how you feel.

I really don't think most people care about your expedite, what they do care about is if things don't work out the way you'll wants it to, don't blame the US government for the welfare of your child.

You have chooses.

No one wants to see a mother seperated from their child, but understand that it's you'll the parents who are making the decisions concerning this child lack of better meducal care, not USCVIS, NVC or the US government.

I never said it is them. I said that i do have a case and it should be looked after. If i need to get her extense medical history and fax them i will. For those who actually care thank you i will keep you pisted for those who have nothing better to do then criticize i have enough stress to deal with. The bullyes can talk alone.
