I-864 -- taxes not paid

I'm the petitioner for my wife's AOS.

My father will be cosponsor.

My question:

I was not required to file taxes the past 3 years as I did not make enough $ when filing married jointly.

The thing is that I have only been on my employers payroll for the past year, (have worked for him for years) I have made the same amount of money for years though.. So I was not required to file..

Is this a problem ?

i don't know for sure, but one think that I keep seeing is that with immigration it is better to file then not.

Just because you are not "required" to file does not mean it it not in your best interest to file. If you employer withheld taxes there is a very good chance he withheld to much and the only way you get a refund is to file for it.

You may still want to file those back years for the refund.

If you weren't required to file that is fine. You still fill in your income on the I-864 and then attach a statement explaining why you did not file (ie because you were not required to due to income).

It is not a problem if you didn't make enough to file. I'll assume you know what this threshold is.

However, you were probably entitled to a solid refund and/or credit which you did not claim by filing. The EITC is free money; all you have to do is file.

Irs website told me for every year that I did not have to file.

This year it's if you're under 65, married filing jointly, $19000, last year I believe $18500

are you saying that if you make believe $19,000.. then you don't have to file?!

i am not a tax person.. but if you get a check and taxes are taken out.. you still need to send in forms..

if i remember correctly.. if you get paid under $500 total.. taxes are not report from boss..

you probably should have/be going to a professional tax person.. no idea what you are referring to on IRS website.. do you have a link?

If you were working under the table (which is illegal) then you owe taxes, such as medicare, SS. I really think you have a tax problem. I can see that your income is under the threshold, but there are other circumstances that make you need to file. From you own link, if you did not pay Medicare, you must file; if you are eligible for EITC, then you must file, etc.

Why do you need to show your tax returns on the K-1 process. Dont they ask for your employment information, and bank deposits. I look at the USCIS website. The only tax returns you need to show is if you work for yourself. AM I wrong?
