Moved from K1 Process & Procedures to Moving Here and Your New Life In America.

Our journey:

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

To my understanding, if I for example earned money in Canada within 2011, that money is reported to the Canadian Gov., if I inturn I didnt earn money in the USA in 2011 I have nothing to report to the US gov. except to say, I earned 0. The US gov. isnt intereseted in my Canadian earnings, and the Canadian Gov. ( in my case ) isnt interested in my US earnings. There is also a 7 month rule about being in the country, and for those who it pertains to there is a 6 month married rule.

Also to my understanding Turbo tax is made to be easy to file with, and doesnt give alot of the more difficult situations a fair area. If you are truly concerned you need to hire a tax preparer so that you can ask these questions, and I wouldnt recommend the big "box" stores for this.

Dec 25 2009 officially engaged

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

--- case says we should hear from them in 60 days from June 18 ---

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

Oct. 5 2010 Interview Passed

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Chicago Lockbox confirms delivery June 3

Check cashed through bank - notification June 9

6 or 7Month rule ?? you mean in order claim someone on your taxes ??

Any money you earned before becoming a US resident is irrelevant for US taxes.

just so I understand correctly, your say we must be married for 6 months before I can claim her on my taxes ??

we only got married in December, but she has spent over 6 months here this year using VWP. but only got SS number in November.

Well still a little confused :unsure: :unsure: she did not earn any income and we have No W-2.

So how do I report her income aside from some government assistance Not USA. just enter Zero? then attach a statement saying we wish to file jointly?

I guess Filing electrically is out ???

You have to file a paper return, since you have to include the required statement. You can go ahead and report any income she received without worry, because there is a huge exemption for income overseas once she met the requirement to live overseas for 18 months or more. Just make a best estimate of her income, in US Dollars. Unless she made lots of money, it really won't matter what you put, it will be all exempted.
