What happens if my financee comes to the US on her tourist visa and we get married?

My friend instead of waiting for her K-1 (they didnt apply yet) and she came here on her tourist visa and they got married. so she could be here while they wait instead of her going home and waiting 7 months or so..

What is the negative about this?

This constitutes immigration fraud, because she used a non-immigrant visa with the intention of migrating. This could bringa barage of problems.

Knowingly committed a visa fraud can lead to potential problems during the AOS process.

If USCIS is able to prove that your friend and his wife knowingly abused the visa regulation(material misrepresentation)… leads to lifetime ban.

05/20/2013...... Bio-metric hard-copy.
05/29/2013...... Biometric scheduled. . Austin office

07/15/2013...... EAD card arrived in mail today smile.png

10/20/2013...... Green Card approved! NOA hardcopy received!

10/31/2013...... Green Card Delivered!!

ROC-I-751
07/21/15 90 day Window Opens

07/24/15 I-751 Mailed to Cali. Service Center
09/03/15 Biometeric scheduled and completed

01/26/16 ROC Letter arrived
01/30/16 10 yr Green Card arrived

This is what will happen. I am not saying that the OP of that thread committed visa fraud. I just want to show you the case when AOS application might be denied based on suspect of visa fraud.

Itr is illegal and your adjustment of status could be denied and your (then) wife would have to return to her country and may be banned for life from any type of visa or entry into the US.

Good luck with that.

I did it legally and sleep very well at night.

Be advised if you pull off the AOS it does not mean that her removal of conditions could not be denied or even her citizenship. If you commit fraud in any part of the process you are subject to having ANY future benefit revoked.
