Hi All,

I have approved I-130s for my wife and her son, Mark, who is 6. We thought it was strange that on the AOS and IV receipts from NVC there was no mention of Mark, so I called NVC and they said that they had just received Mark's I-130 and that these are completely separate cases. Fine. Ignoring the fact that although these I-130s were approved at the same time , Mark's was sent out a couple of weeks later by USCIS, my question is, when and how will the two cases converge? for example so Mark's "interview" is at the same time as his mother's. What is NVC procedure? The NVC help desk was not so friendly this time so I figured I'd ask here first before calling them back. The lady said "they try to keep the interviews on the same day" so I don't think she knows. It is ridiculous to think they would have separate interview times for mother and young son. Are they going to want a separate DS-3032 for him too? Is there any way I can speed Mark's case up at NVC so it catches up with his mom's?

You should asked the lady over the phone are you expecting a 6 year old to do an interview by himself?

I dont have a good answer when the both the application would be merged, but I m guess it should had been togeather since its a family and other person on the application is minor.

Hopefully the embassy would apply some logic and put them togeather.

Many of you people on here have immigrated with kids to the US... and I only get one reply? Procedures and process is what this forum is for, but I guess you are more interested in answering the controversial posts. Thanks.

Once you get that chip off of your shoulder, you can call/email the embassy once you have one interview date and ask that the other petition interview date be set at the same time. It is a simple request.

There is nothing unique about your situation, a polite request will settle it.

Correct but it can be settled now, with NVC. Simply call back and request that the two cases be "joined". This will result in payment of only one $88 AOS processing fee. The cases will then proceed through NVC together and have the same interview date.

yup - the cases can be joined up, married up together, at NVC.

You can stall on payment on the mother's casefile a bit until the son's casefile is added, no worries there.

However - it will require you to email nvc, asking for it to be done.

I called NVC and they "joined" them. They did, however, say that I would still have to pay another AOS fee regardless.

We are going to hold off on sending my wife's DS-230 package in until his case is caught up. Thanks

You should only have to pay the one $88 AOS fee. The way you know they are joined, is that the son's AOS fee will show as paid without paying it. At that point, the cases are both joined and "caught up".

I am happy to hear that. I'm not concerned about $88, but then that is a good indicator that the cases are joined, if the AOS fee for my stepson shows up as paid. I wonder if they will ask him to submit a separate DS-230 also. I imagine so.

Absolutely. Everything will be separate. You'll even submit separate I-864 forms. The only thing that is NOT separate is the $88 fee. Time to study the guides.

Well, you assumed (the OP) that the child was coming since you filed an I-130 for the mother.

After learning 'different', well, there's more stuff that's different, yet to learn.

In a nutshell - ONE I-130, ONE I-864, ONE DS-230 on each of them. 2 Humans? 2 sets o paperwork, as is 2 seperate casefiles.

When you get a moment, do please log in to VJ with a PC running Winders, click on 'guides' at the top bar, study a bit (more).

I've looked extensively, and have not found mention in any guide of the process when there is a mother and child. If you could reply with the guide URL, that would be useful.

The mother and the child are just two people. The only difference is that you won't pay the $88 fee for the child and won't be submitting any original marriage or divorce certificates for the child. Follow the CR1 guide but anything you do for one visa applicant, you do for the other as well.

You filed two petitions, one for each person. Now you apply for visas, one for each person.
