I'm in the process of preparing all the forms and documents for the joint sponsorship and I have a question about I-864A. I'm assuming that if my joint sponsor's income is above 125% the poverty line, then no other household member needs to be included in line 24b of form I-864 and therefore there is no need to include any I-864A from the other household members, correct?

Also, my joint sponsor doesn't feel comfortable providing a bank letter and receiving an employment letter stating the details of his job and income doesn't seem an easy and quick process because of the company he works for.

I'm wondering if providing the I-864, the last three income tax returns and the most recent pay stubs will be enough evidence for the affidavit part of the application. Thanks!

Yes to your first question. Your joint-sponsor will need some proof of current employment, however. Either a letter from employer or 6 months of paystubs. You don't need both.

Yes to your first question. Your joint-sponsor will need some proof of current employment, however. Either a letter from employer or 6 months of paystubs. You don't need both.

Thanks! Forgot to say that my joint sponsor files his taxes jointly with his wife...does that affect anything in the application? Will his wife have to fill out a I-864A just because they have joint tax returns?

The joint sponsor is my husband's uncle. The petitioner (my husband) is self-employed. We received an RFE because although his current income is well beyond the poverty line, he couldn't have enough proof of his current income and his past tax returns were below the poverty line.

Uncles do not meet the test for using the form I-864A. (see page 1 of the I-864A instructions)

Uncles do not meet the test for using the form I-864A. (see page 1 of the I-864A instructions)

The joint sponsor should use the form I-864.

I was sure that the joint sponsor had to use form I-864. I was wondering if anyone in his household (like his wife) would have to fill out an I-864A. They file joint tax returns so I am not sure if that changes anything in the application.

Almost the same thing we are doing!! I am filing one i867 from mr and one from my uncle and i864a is being prepared by his wife who files her taxes with him!!

The tax filing status does not matter. The joint sponsor will complete the I-864 form using only his income information.

If the joint sponsor has enough income to meet the requirement for their household plus the immigrant then the spouse's income would not be needed.

However, there have been cases where VJ members have been required to have the joint sponsor's spouse complete an 864A to show that the spouse is aware of the sponsorship commitment. So, to be on the safe side, have the joint sponsor's spouse complete the 864A. Better to have something that is not needed than have a delay if the 864A is requested.

The first I had seen here on VJ about having the 864A "acknowledgement" was a VJ member doing DCF in Italy. What's an extra few pieces of paper?

That was one of my concerns because last year return didnt meet requirements but all others did and current pay meets. Hoping the best for you, for all of us who are still on this journey. :)
