Timeline

Anyone Filing a I 601 waiver of Inadmissability, through the embassy In Ciudad Juarez Mexico??

May 2005- Met my husband

June 2005- Became a couple

September 2006- 1st son born

July 2007- 2nd son born

June 2010- Married

September 2010-Hired our Lawyer

October 15th 2010- Petition Sent in

December 2010- 1st daughter born

February 7th 2011- Petition Approved

August 3rd 2011- recieved our appointment

September 1st 2011- 1st appointment- denied, but approved for a waiver

November 14th 2011- 2nd appointment, turned in waiver

_ _ _ _ _ - Visa Approved (still waiting as of February 18th 2012)

Anyone Filing a I 601 waiver of Inadmissability, through the embassy In Ciudad Juarez Mexico??

If i may ask, why did your husband need a waiver for?

I have also hired a lawyer and will soon be starting the CR-1 for my soon to be husband after we get married in January and he will need a waiver as well. His tourist visa was cancelled due to they found reason to believe he was working in the U.S. I just wanted to know what your waiver was needed for as i am a little nervous about these waivers etc....

I needed to file a waiver because my husband entered the united states illegally, and he was here for more then 1 year. Entering the United States without inspection (illegally) is an automatic BAN, meaning he cannot return to the U.S., but since he is married to me, a United States Citizen, they will waive the BAN, which makes him eligible to file a waiver of inadmissability. The waiver is going to show hardship that I and our 2 kids will have if he is not allowed back in the United States. If youd like to message more email me at adrianagutierrez152115@gmail.com

Timeline

I needed to file a waiver because my husband entered the united states illegally, and he was here for more then 1 year. You do realize that inadmissibility under 212a9b for unlawful presence children are not qualifying relatives, right? Any hardship to your kids must be turned around and shown to be hardship to you. Children are generally only qualifying relatives for waivers for criminal inadmissibilities.

You are in for a huge awakening if you believe getting an I-601 approved is just a formality. Your attorney will have to show untoward hardship for you, if your husband cannot join you in the U.S. At the same time he or she will also proof that you cannot move to Mexico. There's a reason why some immigration attorneys are specialized in I-212 and I-601 waivers only. It's like you are having chest pain and go to your regular physician. If you need cardiac surgery, you'll need the services of a cardiac surgeon. There is no way that you can pull an I-601 in Ciudad Juarez off on your own.

There are many applicants, especially in CDJ, that file waivers pro se. Having said that, it's not an easy task. It's one that requries a lot of research and writing skills that not everyone has. Personally , our case was extremely complicated and I would have not dared do it alone. I chose a lawyer that we had worked with previously and although she had waiver experience it wasn't/isn't her specialty. If I hadn't hired a lawyer and were denied I would have always blamed myself because I didn't do something more.

I do know that already. But they are mine and my husbands Kids, the medical information of my kids as well as my own was put into the waiver. I AM HIS QUALIFYING RELATIVE. thats why i SAID THAT IM A UNITED STATES CITIZEN, im his wife!!!
