So today was our interview. Everything was going great until the one lady decided to look further and found the visa denial of k-1 visa back in 2008. Consul said that I signed a confession stating that I was doing it as a favor and I was receiving any money for it. Of course it wasn't the case. But back then I didn't know about this sight and we were very unprepared and the consul a that time was intimidating and scary and he literally pushed me to sign that paper. So then we got married and put in a new spouse petition which was denied today. The question now is, what can we do now? Please help. This is very upsetting and sad. I really don't know what to do.

I'm very sorry to hear that :( Two visa denials and a signed letter "admitting" to visa fraud means you are almost certainly into lawyer territory now. Hopefully someone else can point you towards someone.

USCIS (128 days)

January 8, 2011: Mailed Petition for Alien Relative packet to USCIS.

February 1, 2011: Received Notice of Action 1.

May 16, 2011: Received Notice of Action 2. Case handed off to NVC.

NVC (41 days)

June 24, 2011: Mailed Affidavit of Support packet to NVC.

July 12, 2011: Received checklist letter 1.

(Long delay intentional; not counted in processing time.)

October 12, 2011: Mailed Immigrant Visa packet to NVC.

October 20, 2011: Received checklist letter 2.

October 26, 2011: Mailed checklist letter response packet to NVC.

November 4, 2011: Received interview letter. Case handed off to the consulate in KL.

Consulate

November 12, 2011: Completed medical exam.

November 19, 2011: Picked up results, everything clear.

December 1, 2011: Interview - approved!

December 8, 2011: Visa in hand.

POE and beyond

February 5, 2012: POE at JFK, no problems.

February 29, 2012: Applied for and received SSN from the local SSO.

April, 2012: Applied for and received state ID at the DMV.

(Slight delay, had to redo biometrics at the local service center.)

April, 2012: Conditional green card arrived!

Removal of conditions

2014 is right around the corner...

IDK but it sounds like you've been hit with Material Misrepresentation which is a lifetime entry ban.

Lawyer up for sure but I don't know that there really is anything you can do. I can you prove that you didn't understand what you signed back in 2008?


Must have info for bringing your Philippine wife/fiancee's child to the US

This is a sad and unfortunate situation. But as everyone else is saying, this is a lawyer issue now. Definitely not something you'll be able to fix yourself. That signed confession thing is crazy!!!

An immigration attorney with a track record of overturning findings of material misrepresentation is needed. Was the beneficiary the same person then as now?

You have a huge obstacle here in the previous K1 bnot only being denied, but the confession you signed. I agree with pushbrk, time for a good lawyer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
