ok guys this is the deal we had some issues and second thoughts noa2 expired...were about ready to start all over again im getting the new forms together etc should i also send a letter of explanation stateing why we let noa2 expire???

Yes. And at the end of the letter you need to state

"Therefore I respectfully request a waiver from the restriction against more than one approved petition within 2 years"

It is called a "waiver request" and yes, you need one.

I see your NOA-2 was 5/17. Before you start all over again have you contacted the Embassy to see if they will extend your NOA-2 expiration?

It is worth an email to see if you can have them perhaps extend the date. If they won't, then you begin all over again.

thanks for your input guys when you mention embassy since my k-1 visa is from mexico would i contact mexico embassy???thank you guys...

Yes, you would contact the Embassy in Mexico and see if they could extend the I-129F validity for the petition you filed previously.

As I said earlier, they don't HAVE to extend it, but they MAY...

Best of luck.

What do you mean "you let your NOA2 expire". You didn't go to the interview? or what?

It is worth a Email to see if they will extend the Petition. Just as we got approved my Fiancees dad was diagnosed with cancer.Needless to say i contacted the US Embassy in Manila for an extendion. they replied back that I 129Fs routinely gets revalidated for addtional 4 months but that is US Embassy in the Philippines, different from the embassy you must go through. I would suggest Emailing them first!....... as my Dad always say:

I'm trying not to be judgemental, so forgive me please. But I noticed you posted back in October that you were 10,000% sure you wanted to go through with this...it's December now...you waited longer? You really cannot mess around like this. For goodness sake, get a grip and move forward with the process the correct way. Are you sure you're SURE????
