This is not a good idea. Someone just posted about this and missed their biometrics appointment because of getting mail 1 month late while overseas. This is going to cause HUGE problems and probably denial of removal of conditions which means she cannot come back to the USA without the USC filing a new spousal visa for her. Wait until you return to the USA to file.

The thing is February 10 is my husbands R&R, his R&R is just for two weeks, I am only allowed to send the documents on February 13,2013 since that is the first day of 90 days out of the expiration of my card. We were thinking of readying all the documents, sealed it in the envelope and ask my aunt to send it for us while I am in the Philippines, I wonder if they allow that? My son and I are planning to leave the country on January 20th so I could prepare for his christening and all so once my husband arrives everything is ready and everyday is worth all the time. no preparing and no hassle. so that was my first option, to ask my aunt send our documents on Feb 13th, once she received the RECEIPT, she will fedex it to me in the Philippines so I will have no issues when i re enter US again.. The other option is, i'll file the application when I get back. probably april 2012.

Your husband still needs to sign the I-751 -- it is a JOINT petition so both of you need to sign it -- so bring the paperwork with you, he signs and when you come back to the US send it off immediately.

he already signed it before he left the country because we knew we were going to apply for Removal of Conditions. Thank you tho for answering! :)

As tdegrenier stated you have to be slated to live overseas with the USC to be able to apply for the expedition of naturalization. Yes there is such a thing many of my Soldiers and personal friends have been in this situation. They came to the US with their foreign spouse and after only 1 or 2 years were placed on orders for another overseas assignment (normally 3 year tours with family members) in which case the spouse does not qualify for naturalization and because they are only moving there to meet military requirements they are allowed to apply for expedited naturalization through official government passport office on the installation that deals with these cases and all government assignments for dependants before they are required to go to yet another foreign country. I do have to say that if you use this agency you have to request as soon as your spouse receives an overseas assignment or it will delay when you can depart to the overseas location.

At this point none of this applies as your spouse is deployed and his home station is stateside.

Military spouses that are overseas only need to provide deployment orders and they do not have to have the spouses signature on the forms.

This does not work for civilian workers overseas working for the military. Only for active duty military personnel deployed.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

yes you can do this...once your biometrics notice comes, have your aunt send a reschedule request (stating an acceptable reason) together with the notice (have her save a photocopy for you) =)

yes, a month before your gc expires is ok (anytime w/in the 90 days prior to expiration is ok) =)

As for Biometrics -

Their bold and caps-

IF YOU FAIL TO APPEAR AS SCHEDULED,YOUR APPLICATION WILL BE CONSIDERED ABANDONED.

But they do allow for rescheduling. But I would guess only after you have the Appointment Notice in your possesion.

My son will be 6months old by then.. I will not pay for his sit because its gonna be a waste of money since he always want to be carry..

Correct me if I am wrong but aren't children under 2 free as they don't use a seat? And you can file your ROC when you get back. Go and see your husband have fun and then as you have all the paperwork done you can send it off when you return. As long as you file ROC withing the 90 day anniversary of your GC expiring you are good to go. You don't have to do it before you go .

yes children under two are free.. I was just advised that It would be comfortable for me and for the baby to pay for an extra seat. But I dont think i would buy him seat.

A little hint about flying with your infant . . . bring your carseat with you to the gate of the airplane. If the flight is not full, they will let you use the carseat in an other wise empty seat. If there is not an empty seat, they will gate check it for you. Holding an infant for 15 hours will be hard.
