On April 23 2011 I went to pakistan and met my 2nd cousin, and we decided to get engaged. NOT MARRIED YET. So after arriving back in usa, I filed I-129F and competely submited all the forms they needed. Got a letter on june 6 that they have recieved my application and it is now processed at California service center. Today, oct 29 2011, i received this letter which states that "RESPONSE TO INTENT TO DENY" and i have till november 25 2011 to resubmit the items needed. But here is the deal, Everything they want now is already been submited when i filed the I-129f. here is what they want me to send them...and what i have sent them already...

They want......Original statment From each petiontioner and benificiary stating they plan to marry each other within 90 days of benificiary addmision to usa.

I have submited, a letter stating exactly that, and it is both signed and dated by me and my fiance when i was in pakistan. They want.....IT must be establised the petioner and benificiary have met in person during the two years immediately preceding the filing of petion. I have submited, My usa passport page showing my current visa to pakistan, The page of passport showing enter and exit stamps at Islamabad airport, 4 pictures of me and her together in differnt places. Lastly the letter object that we can not marry because Arizona law(thats where i live) does not allow cousins to get marry. Howerver on the application i have clearly indicated that she is my SECOND COUSIN. I checked the law in arizona and it is perfectly legal in Arizona for 2nd cousins to get marry(maybe the uscis dont' know that??)

Anyways what should i do now? should i resubmit all the information they want, eventhouhg its gonna be the same information or should i call my state senater office or an attorney. Please let me know. Any idea how long this will add to my wait.

I'm not sure if you sent only 1 letter of intent with both peoples signatures or 2 separate letters written differently by the both of you but they want 2 letters one from each person not 1 signed by 2 people.(your wording is a little hard to understand on that one)

Submit all the stuff they want again and send extra.

Just my sneeky suspicion,... I'm guessing that someone at the uscis doesn't particularly care about pakistan,, and then on top of that, they didn't care too much either, that you wanted to marry your second cousin. If someone at uscis was a very conservative person, .. this just sounds like a freakn bombshell ready to explode.

I'm actually a little surprised at the vast number of people filing for pakistani fiancees, here on VJ. I'd guess there's alot more scrutiny, with the lack of affection between the USA and Pakistani governments these days. "Rightfully" so.

It was 1 letter that was signed and dated by both of us. Can she just email or fax me her letter and i print that at home and send that along with my letter and other stuff they need, or it has to come in mail from pakistan to here ?

No everything must be original signatures. It cannot be a scan or fax. She will have to mail any forms or letters etc to be used with original signatures on them.

this is the only reason why you received the rfe because you sent 1 letter of intent when the application clear states that each person has to send his own letter of intent all you have to do is send her the letter by email have her print it out and sign it and send mail it back to you asap.

resubmit your boarding pass to show you was there and throw in about 2 pic of you and her together that's all they want.

The I-129F instructions require "original statementS (plural) from you and your fiancee". Send two new letters of intent with original signatures. It's best not to presume they'll use the one you originally sent as valid for either of you, so just assume that letter is null and void.

If you have more evidence of having met within two years then send it, along with copies of the evidence you've already sent. They're suspicious that you're trying to help a family member immigrate, so any evidence you've sent so far is apparently suspect to them. You need a pile of evidence that's clear and convincing. If you only made one trip then you can expect this might be an issue at the consulate interview.

Obtain a copy of the Arizona law that permits marriage between second cousins and provide a copy of it, along with a cover letter explaining that it's legal. If you have the URL for an official State of Arizona website where the statute can be viewed then provide the URL in your cover letter.

You should look at your case objectively. Pakistan is moderately high on the list of high fraud countries, and very high on the list of potential terrorist countries. You're marrying a second cousin. The suspicion that you're trying help a family member immigrate for some nefarious reason is going to be high. At each stage of the process you should be focusing on having a mountain of evidence in your favor, as well as evidence to counter any potential red flags. You've gotten an RFE that lists, among other things, proof of having met. This is a golden opportunity to address those red flags with some frontloaded evidence.

Pics that have landmarks are good and a photo that can be dated is great. Like holding a local newspaper with date showing.

no, no , no, don't include pic show you holding a newspaper because some will view it as you try to stage something!!!!

A better alternative is to go to the movie complex and if a block buster is showing take a pic there with the posters that show what's playing in the back ground without it being obvious because anyone that looks at the pic will see the back ground posters and be able to put a year range on it. for example, transformers dark of the moon, even if you did see it you know that it was released in the last 2 years.

why in the world would he need a lawyer, so you want him to pay 600 dollars for someone to place a stamp on an envolpe with 2 pieces of paper and a couple of pic in it?

all the uscis is asking him for is the letters of intent. he sent in one with both of their signatures when he was suppose to sent in two separate letters signed.

and in your case even with a lawyer there's nothing that anyone can do if it's in AP all you have to do is wait until they're finish processing your application. I myself am in AP it's frustrating but I have to wait. I know why I'm in AP I thought the uscis was going to send me an rfe, but they didn't so the nvc picked up on my problem.

Is your marriage an arranged marriage? seems a little strange that you would go to Pakistan knowing that you'd need her signatures on certain papers. you could also include your boarding passes and receipt for airline ticket if you havnt already. Do you have much of a paper trail of having a relationship with her...phone call records,emails,chats,skype. Is a 2nd cousin a first cousins child? I guess it's a plus that you are petitioning her and not the other way around. Best of luck!

Actaully my brother did his marriage the same way and he went to pakistan , got engaged, came back and applied and got approved, but that was 5 years ago. My friend who got his visa approved and his fiance here within 5 months, did the process in jaunary 2011, So i followed both of their paper trail and sent exactly what they sent. Even my friend sent the one letter with both statemets on same page. I mean it says as the other poster pointed out "The I-129F instructions require "original statementS (plural) from you and your fiancee". it does not says send each statement on seperate paper but just to send 2 statements. Which we had on same page but it was 2 different paragrahps, one written by her and one by me, then both of us signed it. But i guess it dependes on the case officer. Also the pictures are printed at walgreens and we took it on digital camera, so i dont think that pictures can be dated when taken with digital camera and then printed at a store. I will send all the information they need and then some, and then wait to see what happen.

Because this is exactly what USCIS requests when they send an RFE for pictures. One of you and your SO with a newspaper.
