Hello,

I am going to file my fiance K-1 visa and i have read somewhere that you just add any children who are under 21 to the K-1 that you don't need to fill out another form for the child, Ok so do i have to fill out a visa application for the child and also do i have to get a letter from the child's real father even though he hasn't been around sense she was 1 she's now 7 ,he hasn't given any support or anything? Thanks

My wife and I used a lawyer, and persuaded my son's biological father to sign a release for us to bring him to the United States. She needed full power in order to make life's decisions for him. We were not told to do this. We saw it as a prudent thing to do, and we wanted to advocate for our son's future. We have not cut off communication with our son's other side of the family, and once our son is able, and he wants to, he has our permission to go visit his first father, and his family.

There are many real, legal reasons to obtain permission from a child's first parent, especially here in the United States. Schools are always following the letter of the law, and we offer up a copy of this contract to whom ever we feel that it is necessary to have.

Sounds like safe thing to do? But her birth father like i have stated has never been around therefore his parents have never had anything to do with her either, And i don't think my fiance even knows where he is? She did find out a while back that he has already married and has kids with the person he married

As for the K-2 maybe that comes after you get the approval for the K-1, I'll do more research on it.

You file k1 and k2 at the same time.

We just did k1/k2 and when I was at the consulate in Vancouver, the agent that did our interview specifically asked for the custody document. You must present it again at the interview for AOS. It's a mandatory document to have.

Okay, first it is the petition. The application will be separate. No, you do not have to fill out a seperate petition for a K-2 visa, but be sure the child is listed on the forms. Secondly, with my daughter (technically step-daughter), the US gov't didn't ask for anything over custody. They didn't care. However, we did have to go to court to get permission from the Peruvian gov't (which is one of the two time the dirtbag saw her, the other after leaving and refusing to pay the hospital for the birth). We did that to leave the country and to make it easier for me to adopt her here. So, I would check Philippine law over custody permission.

Yep, you list ALL the beneficiary's children on the 129f form (all of them, regardless if they are immigrating or not).

Then on the DS-156 (or maybe the DS-156K) form, which is done for the interview, you list which of all those children are going to immigrating either long with or to follow within one year of the beneficiary. It's that simple.

Yes also notarized. Money usually helps convince them to sign.

US will follow Philippines law on parental rights. If she was married and got annulled father has no rights. If never married it cn depend on if father signed the Birth certificate and what last name the child was given. You should research this, you my not need to track the father down for a letter. Philippines law is unlike many countries on this matter. Jim
