My wife and I are planning to apply for a CR-1 visa in the next few days, however our anniversary will be in February and that will be two years that we have been married. What should I do? Can I apply for an IR-1 visa? If not, is it ok to apply for adjustment of status when she gets here even though we will be way past our second anniversary?

It is the same paperwork for either, and what matters is when you enter the US--not when you file. You will be (should be) issued an IR-1 visa at the embassy several months down the road.

its so simple , Apply now, it will take several months to get the NOA2 then NVC time and bla bla bla ,till you have your interview you will be passed you 2nd anniversary so they will print a IR-1 visa for you not CR-1 but you need to mention that to the consular so he wouldn't mess it up and even if he did , just tell them at the port of entry and they will stamp you an IR-1 visa :)

hi there.. based on some of the articles i have read before, with other couples reaching their 2nd year anniv upon POE, the CR1 is automatically stamped with IR1 upon entry..there is a thread about that somewhere... :D

NVC received AOS and IV packs = Nov. 3, 2011

NVC RESPONSE = Nov. 8, 2011 - RFE for missing proof of relationship with co-sponsor

Mailed RFE file = Nov. 9, 2011

NVC received RFE = November 14, 2011, 9:54 am, PORTSMOUTH, NH 03801

CASE CLOSED = Nov. 18, 2011 :D

MEDICAL EXAM = Dec 20-21, 2011 = PASSED!!!

INTERVIEW DATE = January 6, 2012 = APPROVED!!! ----Our interview took 250 days from our I-130 NOA1 date.

VISA PRODUCTION = January 6,2012

VISA DELIVERY = January 11, 2012

POE = Feb.18, 2012

SSN Received = Feb 25, 2012

GC received = April 5, 2012 (incorrect data entry :((, sent back April 9, 2012)

CORRECT GC RECEIVED = August 22, 2012, granted IR1 (10 year gc)

that's where our USCIS process ends for now.. will wait for the next 3-4 years what we'll do next...

ya, this 2 year window can be 'evaluated' on either:

1. interview day by VO

2. POE date by CBP officer, when you ask them to do so.

Has nothing to do with the date the I-130 was filed.

i have a follow up question: if for example one will be entering POE prior to second year anniv, will there still be payments to be made for the renewal of CR1 to IR1 visa

and if entering POE a day or 5 days after second wedding anniversary, will it be alright?

If your partner enters the US before your second anniversary, s/he will be given conditional status. S/he will have to apply for removal of conditions 90 days before the second year from the day s/he entered the US.

My husband and I filed our I-130's last month, and our second anniversary is in April next year. IR-1 and CR-1 visa applications are the same process, except for that tiny bit about the second anniversary.

I suggest you file ASAP, because looking at other people's timelines, it will still be a (long) while before we all get our visas..=(

10/04/11 - NOA-1

04/05/12 - NOA-2

Your I-130 was approved in 184 days from your NOA1 date.

NVC

04/23/12 - NVC received both cases (18 days/12 business days from NOA-2)

05/07/12 - Case numbers and IIN's (14 days/10 business days since NVC received)

05/07/12 - Sent out DS-3032 by email; auto-response received

05/08/12 - AOS fee invoiced, paid - "IN PROCESS"

05/09/12 - AOS fee shows as "PAID"

05/10/12 - Spouse's DS-3032 accepted; minor child's rejected = had petitioner call NVC = received verbal acceptance from operator
