Spouse is considering moving back to the home country

Hello All,

My F2A beneficiary spouse is currently in a foreign country and is considering moving back to the home country. Would this jeopardize his immigration process? His case is complete at NVC and is currently waiting for the PD to become current. If he decides to take this route, who should we inform about the change of address etc so that consular processing will take place in the home country when the PD is current?

04/19/2011: AOS fee paid

05/07/2011: IV Fee paid

05/13/2011: AOS received

12/19/2012: Became US citizen and request sent to upgrade from F2A to IR/1

01/13/2013: Case completed (again!!)

04/02/2013: Interview (Approved)

It will not affect the immigration process at all. You will need to contact the NVC now and inform them that the applicant would like to conduct the the interview in his home country.

i have the same question!! My beneficiary is planning on moving back to his home country in the next few months. Our case was recently approved and I received the NOA2 last month. Should i call NVC now? Or should I wait until a case number has been assigned? So much confusion!

Since your case is in limbo you should wait until a case # is assigned. Should u call USCIS they will advise you the case was approved and is no longer with them and direct you to the NVC. The NVC cannot help you until they have opened the case file , assigned a case # etc because they have no idea a case was approved until received.

A followup question regarding spouse moving back to home country.

His PCCs were issued in May 2010. Our PD is 01 Nov 2010 and I don't expect it becoming current before May 2011. Would that mean he will have to resubmit PCCs from both countries again?

Yes, they are usually valid a year, even if you haven't travelled to the country of the PCC since then.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
