Need help starting the CR-1 Process after K1 Denied

My fiancee was denied the K1 in Guangzhou so now we are going to get married and go through it all again.

How do I get the certificate of Marriageability while I am in the US? I see I can go to a US consular in China, but I want to get the form now and not have to travel from her town to the nearest US consulate. Also I live in Sunnyvale CA which is 40 miles or so From San Fran Chinese Consulate yet their district map seems to imply that "Northern California" is everything north of the bay and I that I am served by the LA office.

Anyway this just happened so I have had no sleep and I just need someone to push me in the right direction.

It was denied due to insufficient proof of relationship. We 'only' had 30 photos, her English is not very good, though she has been taking classes and we communicate fine and they didn't like the fact that I only visited 1 time even though it was for 4 weeks. Or in short, the interviewer scanned the file, saw a couple of things she didn't like, grilled my fiancee to the point of tears and denied it with a white slip. We are going to embark on a ridiculous photo journey during my next visit that may or may not include us making a bunch of crude gestures in front of the GZ Consular.

Not that any of this is relevant to my question. How do I get the marriageable certificate?

sure it is..

if you know WHY k1 was denied.. then that issue can be befix for the CR1.. or if you try K1 again.. you came here asking for help.. the more details you give.. can get you better answers and possible solution to your problem..

ps.. bummer about the denial.. thats suck.. hope it ends up with a happy story for you in the near future

You know yer going over again, anyway - so bring the certified copies of yer divorce documents, start there.

I would much rather get it beforehand because makes things even more complicated because Beijing is very far from Xi'an

And to skiptex, with all due respect; I asked how to get the marriageable certificate, not for advice on what to do next. I already made up my mind on that one. Redoing the K1 may be marginally quicker, but it has a greater chance of denial than the CR-1 given that we have been denied once. Additionally I want to show my fiancee that I am committed to her, especially since she is feeling really bad right now. It might sound kind of lame, but she will appreciate it.

How do I get the certificate of Marriageability while I am in the US?

Write a statement that states your are single, if you are divorced, give the date of divorce. If you have never been married, so state. In this statement, include your date of birth, your job and employer, your passport number and your address. Have the statement notarized.

Send the statement to the secretary of state of your State and obtain a certification. Once you have the certification, send the statement and certification to the Chinese Consulate that has jurisdiction where you live along with an application for authentication. The Consulate will authenticate the certification.

It's a long complicated process. Definitely would be easier if there was a US consulate conveniently located in XI'an. I better get cracking on it.

A follow up to my last post, when you submit your statement to your state's Secretary of State's office, the division you will want to send it to the division that handles apostilles.

When it comes time to obtain the authentication from the Chinese Consulate of jurisdiction, you will want to follow the instructions for authentication of documents.

Prior to going to China to get married, I did get the needed documentation stateside instead of going to the Embassy in Beijing or making a trip to one of the Consulates.

Contact http://visarite.com/ Call them and ask about the "affidavit of single status". They'll walk you through what they need, then walk the papers through the places they need to go in New York. It doesn't matter which state you live in. They can do it all for you. I was happy to hear of them in 2005 prior to my marriage and know many who have used them before and since.

It doesn't matter which state you live in. They can do it all for you. I was happy to hear of them in 2005 prior to my marriage and know many who have used them before and since.

Visarite is the way to go for me. Thanks for the suggestion. I can get that and a new visa with one stop at my local post office. :)

Right. I haven't ever used them for a visa but saving on shipping is good. Once you have the papers back from them, I would go ahead and priority mail them to your fiancee and ask her to take them to the marriage office to see if they are OK as is. If not, she can get anything translated that might be needed. Some Marriage Offices accept the as is and some don't. Nanning doesn't. Guangzhou does. Go figure.

For the future, once you're married you can get the same visa at the same price good for two years. The people who know how to do that are mychinesevisa.com but use the Houston or Chicago office, as the SF Consulate won't issue the two year visa. Same money.
